REIMBURSEMENT AGREEMENT <br /> <br /> THIS AGREEMENT, made and entered into by and between <br />the CITY OF PLEASANTON, a municipal corporation (hereinafter <br />referred to as CITY), and BLACKWELL HOMES, a partnership <br />(hereinafter referred to as BLACKWELL). <br /> <br /> RECITALS: <br /> <br /> 1. On July 24, 1979, the City Council of the City of <br />Pleasanton adopted Ordinance 894 approving the planned unit <br />development application for a 108-lot residential subdivision <br />located immediately easterly of Sunol Boulevard between Mission <br />Drive and Pico Avenue (PUD-77-10). <br /> <br /> 2. Condition number 26 of said PUD approval states "that <br />because the proposed development will increase traffic on <br />Mission Drive to a considerable degree, the developer shall <br />participate in the cost of installation of a traffic signal at <br />the intersection of Sunol Boulevard and Mission Drive, the extent <br />of this participation to be determined in conjunction with the <br />tentative map." <br /> <br /> 3. On June 11, 1980, the Planning Commission of the City <br />of Pleasanton approved Tentative Tract Map 4611 for a 105-lot <br />single family residential subdivision on the land covered under <br />PUD-77-10. <br /> <br /> 4. Condition number 12 of the Tentative Map approval states <br />"that the developer participate in the installation of a traffic <br />signal at the intersection of Sunol Boulevard and Mission Drive <br />to the extent approved by the Planning Commission in order to <br />effect safe access to and from the subject property and to avoid <br /> <br />-1- <br /> <br /> <br />
