increasing the level of congestion at this intersection. The <br />extent of the developer's participation has been tentatively <br />set at fifty percent (50%) of the cost of a four-way signal with <br />provisions made for turning movements, pedestrian crossings and <br />for special consideration of the frontage road movements. <br /> <br /> 5. BLACKWELL is the successor in interest to Mission <br /> <br />Park Investors, the developer of the proposed PUD and accepts <br />said conditions and responsibilities. <br /> <br /> NOW, THEREFORE, the parties hereto agree as follows: <br /> DEVELOPER A~REES: <br /> <br /> A. Developer agrees to install or finance the installation <br />of a traffic signal at the intersection of Sunol Boulevard and <br />Mission Drive prior to one year from the date of execution of <br />the subdivision agreement. <br /> <br /> B. Developer agrees that in the performance of this agree- <br />ment, the determination of the City Engineer regarding detailed <br />specifications of the signal consistent with recital number 4 <br /> <br />above shall be final. <br /> CITY AGREES: <br /> <br /> A. CITY agrees <br /> <br /> to reimburse developer for fifty percent <br />(50%) of the cost of the traffic signal as soon as such funding <br />is placed in the Capital Improvements budget by the City Council, <br />but in any event, in not more than five (5) years from March 25, <br />1981. <br />/// <br /> <br />-2- <br /> <br /> <br />
