<br />RESOLUTION NO. PC-2025-18 <br /> <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RECOMMENDING THAT THE CITY COUNCIL APPROVE <br />AMENDMENTS TO CHAPTER 18.106 OF THE PLEASANTON MUNICIPAL CODE <br />TO COMPLY WITH STATE LEGISLATION FOR ACCESSORY DWELLING UNITS <br />AND JUNIOR ACCESSORY DWELLING UNITS [CASE P25-0026] <br /> <br />WHEREAS, state law authorizes cities to act by ordinance to provide for the creation <br />and regulation of accessory dwelling units (“ADUs”) and junior accessory <br />dwelling units (“JADUs”); and <br /> <br />WHEREAS, in recent years, the California legislature has approved, and the Governor <br />has signed into law, numerous bills that, among other things, amend <br />various sections of the Government Code to impose new limits on local <br />authority to regulate ADUs and JADUs; and <br /> <br />WHEREAS, on March 2, 2021, the City Council adopted Ordinance 2213 to modify <br />Pleasanton Municipal Code (PMC) Chapters 18.08, 18.28, 18.32, 18.36, <br />18.44, 18.46,18.84, and 18.106 to implement state law changes enacted in <br />2020 to comply with state legislation pertaining to ADUs and JADUs; and <br /> <br />WHEREAS, on May 7, 2024, the City Council adopted Ordinance 2277 to modify PMC <br />Chapter 18.106 to implement additional state law requirements for ADUs. <br /> <br />WHEREAS, effective January 1, 2025, Senate Bill 1211 amended Sections 66314 and <br />66323 of the Government Code, and Assembly Bill 2533 amended Section <br />66332, changing the requirements for local governments related to ADUs <br />and JADUs; and <br /> <br />WHEREAS, the proposed amendments to the PMC implement the requirements of <br />state law and add local policies that are within the scope of the state law; <br />and <br /> <br />WHEREAS, the Planning Commission reviewed the amendments to the P MC at its <br />August 27, 2025, meeting and recommended approval of the amendments <br />by the City Council. <br /> <br />NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of <br />Pleasanton, based on the entire record of proceedings, including the oral <br />and written staff reports and all public comment and testimony: <br /> <br /> <br />Docusign Envelope ID: FD37BC50-16A9-4A2B-9F94-C7D1479C899D
