Resolution No. PC-2025-18 <br />Page 2 of 2 <br /> <br /> <br />Section 1: <br />The Planning Commission finds that the proposed code amendments are statutorily <br />exempt from the provisions of the California Environmental Quality Act (CEQA) <br />pursuant to Public Resources Code Section 21080.17 and CEQA Guidelines 15282(h) <br />in that CEQA does not apply to the adoption of a local ordinance implementing the <br />provisions of state ADU law, which is set forth in Government Code Section 66310 et. <br />seq. The amendments are further statutorily exempt pursuant to CEQA Guidelines <br />15268 in that they are a “ministerial project,” involving little or no personal judgment. <br />Additionally, the amendments are exempt pursuant to CEQA Guidelines Section <br />15061(b)(3) in that it can be seen with certainty that there is no possibility that the <br />amendments may have a significant effect on the environment. <br /> <br />Section 2: <br />The Planning Commission hereby recommends that the City Council approve Case <br />P25-0026, amendments to Chapter 18.106 of the PMC to comply with state legislation <br />for ADUs and JADUs, as shown in Attachment 1 to this resolution. <br /> <br />Section 3: <br />This resolution shall become effective immediately upon its passage and adoption. <br /> <br />PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of <br />Pleasanton at a regular meeting held on August 27, 2025, by the following vote: <br /> <br />Ayes: Commissioners Jain, Mohan, Pace, Wedge, and Chair Morgan <br />Noes: <br />Absent: <br />Abstain: Commissioner Jagoe <br /> <br />ATTEST: <br /> <br /> <br />__________________________ ______________________________ <br />Melinda Denis Ken Morgan <br />Secretary, Planning Commission Chair <br /> <br /> <br />APPROVED AS TO FORM: <br /> <br /> <br />__________________________ <br />Kimberly Cilley <br />Assistant City Attorney <br />Docusign Envelope ID: FD37BC50-16A9-4A2B-9F94-C7D1479C899D
