ties hereto. <br /> <br /> The terms of this release are contractual and not a mere <br /> recital. This release is executed without reliance upon any <br /> representation by any party concerning the nature or extent of <br /> the legal liability therefore. The undersigned have carefully <br /> read and understand the contents of this mutual release and sign <br /> the same as their own free and voluntary act. <br /> <br /> Each of the parties hereto agrees to bear its own attorneys' <br /> fees and costs of suit in connection with this matter. <br /> <br /> The undersigned do hereby release and waive all rights <br />conferred upon the undersigned by the provisions of Section 1542 <br />of the Civil Code of the State of California, which reads as <br />follows: <br /> <br /> "A general release does not extend to the claims which the <br /> creditor does not know or suspect to exist in his favor at <br /> the time of executing the release, which if known by him <br /> must have materially affected his settlement with the <br /> debtor." <br /> <br /> It is understood and agreed that this settlement is not an <br />admission of liability and is a full accord and satisfaction of <br />doubtful and disputed claims. <br /> If suit is necessary to enforce any of the provisions of <br /> <br />this release, the prevailing parties shall be entitled to attor- <br />neys' fees and costs of suit. <br /> <br /> This agreement is binding upon and shall inure to the bene- <br />fit of the'heirs, executors, successors and assigns of the par- <br />ties hereto. <br /> <br /> This agreement may be executed in counterparts, each of <br />which shall be deemed an original, and said counterparts shall <br />constitute but one and the same instrument which may be suffici- <br /> <br /> <br />
