WHEREAS, Goe further claims damages as a result of the <br />proceeding and eminent domain entitled, City of Pleasanton, a <br />~4unicipal Corporation, Plaintiff vs. Joseph Antonini, Excutor of <br />the Estate of Virginia D. Perry, the heirs and devisees of <br />Virginia D. Perry, deceased and all other persons claiming by, <br />through or under said decedent all persons unknown claiming an <br />interest in the property, and Does 1 through 10, inclusive, filed <br />March 14, 1984, Alameda County Superior Court, action number H- <br />97407-1; and <br /> <br /> WHEREAS, pursuant to said action Goe has been served as a <br />Doe Defendant; and <br /> <br /> WHEREAS, all of the above claims, disputes, differences, <br />rights, duties and obligations arise out of and concern that <br />certain real property situated in the City of Pleasanton, County <br />of Alameda, described in Exhibit "C" attached hereto and incor- <br />porated herein by this reference; and <br /> <br /> WHEREAS, Goe and the Estate of Perry have agreed to settle <br />all of said disputes and differences by dismissal with prejudice <br />of the aforementioned complaint of Goe against the Estate of <br />Perry, the filing of the receipt and satisfaction of Goe's Cred- <br />itor's Claim, the release and discharge by Goe of the City of <br />Pleasanton, the payment of money and the execution of this mutual <br />release in the manner herein appearing. <br /> <br /> NOW THEREFORE, in accordance with and pursuance of the <br />dismissal with prejudice of the aforesaid complaint, Goe does <br />hereby release and forever discharge the Estate of Perry, Joseph <br />Antonini, its Executor, the heirs, devisees and beneficiaries of <br />Virginia D. Perry, deceased, and all persons claiming by, through <br /> <br /> 2 <br /> <br /> <br />
