for recycling, resource and recovery with a few acres going towards the Company's truck
and equipment, which provides maintenance services.

A written communicatJ.on was provided by Mark Priscaro, 4241 Garibaldi Place,
who believed Pleasanton Garbage Services residential rate for a 30 to 35 gallon container
is double that of what is charged to Dublin and Livermore residents. I-Ie believed that a
more than 12 percent rate hike is unwarranted, and he remains concerned that ongoing
litigation and other costs unrelated to garbage collection involving Pleasanton Garbage
Services are unfairly being borne by Pleasanton residents.

Mayor Pico closed the public testimony.

It was moved by Mayor Pico, seconded by Ms. Hosterman, to approve
Resolution 04-055, a resolution establishing fixed and uniform refuse collection rates
for the period July I, 2004 through March 31, 2007, to conditionally approve an
additional 1.14 percent rate adjustment for the operational expansion pending
completion of the review of the conditional use permit and associated requirements
(this adjustment would only be implemented after Council is satisfied that the
proposed expansion were appropriate), to direct staff to meet with Pleasanton
Garbage Services on an annual basis to monitor company revenues and
expenditures, and to address the "lag" year issues as indicated in the staff report.

In response to an inquiry by Mr. Brozosky, Mr. Fialho indicated that staff was
comfortable with the conditional approval of the 1.14 percent rate adjustment.

Ms. Ayala indicated that she would support the motion; however, she encouraged
Council and staff to look at ways to cut costs.

Mr. Brozosky believed Council and staff could evaluate whether all of the
services that are provided by Pleasanton Garbage Services are actually needed.

The roll call vote was as follows
AYES: Councilmembers- Ayala, Brozosky, Hosterman, and Mayor Pico
NOES: None
ABSENT: Councilmember Campbell
ABSTAlN: None

There was a break at 10:00 p.m.

The meeting reconvened at 10:09 p.m.

6._~e
Acceptance of Certification of the Initiative to Save Our Community Park Petitions
and other issues concerning the Initiative.
