Mr. Swift explained the mitigations to be constructed are the same that would have been
installed with the original 2000 home proposal and considerably more commercial/office square
footage. The improvements at Valley/Bemal are under construction and will have capacity for
all movements at LOS D at full build out. There are also about $15 million in improvements for
the 1-680/Bernal interchange intersections and the City is studying what kind of improvements
are necessary.

Kevin Rabon, 3127 Washoe Way, said he liked the gas station at this end of town. He
did not like the colors and wanted more tans and beiges no matter what service station company
is selected. He noted a service station in Brentwood was able to do that.

Mr. Swirl said the colors on the renderings are what are proposed. The conditions of
approval state any modification would have to go back to the Planning Commission. Council
could modify those colors if it chose.

Mr. Hirsch presented a color board with the most accurate color shades. He said those
colors were in keeping with the color scheme of the KB Homes units. The yellow will be muted.

Ms. Michelotti asked what restaurants were being considered.

Mr. Hirsch said they had been approached by Jack in the Box and the Planning
Commission was not supportive. He has talked with three or four coffee establishments,
including Starbuck's. This is a costly project and they want to make certain whatever business
goes in will be successful and they can be proud of it.

Mr. Campbell did not think there was another gas station like this in America.

There were no further speakers and the public hearing was closed.

Ms. Dennis could not find the condition that required the gas station to be free of MTBE.
She would feel more comfortable if that condition could be added.

Mr. Swirl said it was not in the conditions, but has been part of the developer's
representation from the beginning.

Ms. Ayala also wanted to add that condition.

It was moved by Ms. Michelotti, seconded by Ms. Dennis, to introduce Ordinance
No. 1868, to be read by title only and waiving further reading thereof, approving the
application of Bernal Partners, LLC for a PUD development plan, as filed under Case
PUD-02-4M, and adopting Resolution No. 02-100, approving the application of Bernal
Partners, LLC for a conditional use permit, as filed under Case PCUP-61, with the added
condition that no MTBE be in gasoline sold at this site.

Pleasanton City Council 26 09/03/02
Minutes
