Jack Hovingh, 4250 Muirwood Drive, indicated he was on the Planning <br />Commission that drafted the first set of guidelines for the Foothill area and related <br />various structures that he had objected to. He was concerned about structures that <br />appeared overly massive when viewed from Foothill Road. <br /> <br /> Ed Churka, 507 St. John Street, indicated he was uncomfortable with government <br />control of this area and felt it was destroying individual creativity. Changing the color of <br />a house will not hide it. He questioned what the purpose of the regulations on grading <br />were. If the purpose is to preserve the hill, he said even on flat land a lot must be graded <br />before it can be built upon. He stated some homes in Wyoming, Montana and Colorado <br />were being built into berms because of weather conditions. He referred to the attempt to <br />save the trees and said the trees could be removed ira fee is paid and asked if that was <br />really protecting the trees and environment. He felt this was trying to control individuals <br />and forcing them to sell to developers who will build as much as possible for every <br />cluster. He referred to limits on two or three story homes and said some three story <br />buildings are defined by hill slopes where they are three stories when viewed from the <br />bottom but are only one story when viewed from the top. How does staff determine <br />where 22 feet is on a hill. He also thought 4000 square feet was not much of a house for <br />people like John Madden or other people who built at the end of Bemal Avenue. They <br />would not be there if there had been a limitation earlier. He felt these regulations were <br />too late to protect that area. It should have been done thirty years ago. However, he did <br />not think the City had done badly, there are a lot of trees in the City, the streets look good <br />because of the trees. When you look down on the City from the hills, it is greener than <br />the surrounding area. No mention was made about overhangs. Carpenters used to build <br />porches to protect from the sun and if there is an overhang one would not see the color of <br />the wall and he felt any color could be used. <br /> <br /> Jeanette Westbrook, 10890 Dublin Canyon Road, agreed general guidelines are <br />needed for new homes but the first consideration should be the individual. A property <br />owner should have the right to be heard and an exception should be made if there is good <br />reason. These rules regarding such a personal thing as a residence must allow for <br />individual expression with reasonable City guidance. The proposed guidelines call for <br />darker colored homes and she did not feel they should be too dark because they will be <br />ugly dark patches on the hillside. Using individuality is creative and interesting and such <br />homes are an expression of personal art and will delight most onlookers. Moderation is <br />the answer and she felt the questions can only be answered by both parties listening to <br />each other without undue pressure. <br /> <br /> Michael Kliment, 5142 Foothill Road, referred to Mr. Hovingh's comments and <br />indicated at the time he was supporting the Hempy development and felt it would take <br />driveways off Foothill Road. He was concemed about the direction the proposed <br />guidelines are going. Ten years ago he asked if the guidelines would affect remodeling <br />of the existing homes in the area, including tearing down one and putting up another. He <br />was told that if it were a lot of record, it would not be affected by the requirements. All <br />the homeowners in the area have tried to conform to the spirit of the guidelines.
