Tract 6563 <br />(SR 94:379) <br /> <br />Randall Lum presented the staff report. <br /> <br />Vice Mayor Dennis declared the public hearing open. <br /> <br />Ms. Mohr asked for clarification that the District would not pay for repairs. <br /> <br /> Mr. Lum explained that the District does not budget for repairs, but if necessary it could <br />order the improvements and then set the assessments to pay for them. It budgets and pays for <br />routine maintenance. <br /> <br />There being no further testimony, Vice Mayor Dennis declared the public hearing closed. <br /> <br /> It was moved by Ms. Mohr, seconded by Mr. Pico, to adopt Resolution No. 94-135, <br />ordering the formation of the Geologic Hazard Abatement District and appointing the City <br />Council as the Board of Directors; to adopt Resolution No. 94-136, appointing officers for the <br />Geologic Hazard Abatement District; to adopt Resolution No. 94-137, declaring its intention to <br />order that the cost and expenses of maintenance and operating an improvement shall be assessed <br />against the property within the district and setting a public hearing for the Board to hear protests <br />concerning the proposed assessments. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers - Dennis, Mohr and Pico <br />NOES: None <br />ABSENT: Councilmember Scribner and Mayor Tarver <br />ABSTAIN: None <br /> <br />Item 7c <br />AP-94-10/UP-94-52.
