Councilmember Brandes expressed concern that in allowing the Variance it would <br />set a precedent, and he felt the necessary findings could not be established to <br />allow this Variance to be granted. <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by <br />Councilmember LeClaire, that Resolution No. 77-130, denying the appeal of the <br />City Council to a decision of the Board of Adjustment in approving Application <br />V-77-3 of James T. Early for a Variance to Section 2-5.38(f) of Article 3, <br />Chapter 2, Title II of the Ordinance Code of the City of Pleasanton to allow <br />the erection of a fence and a wall greater than six feet in height in the side <br />and rear yard of a house located at 7567 Olive Drive, zoning for the property <br />is R-1-6500 (Single Family Residential) District, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, Mercer, and Mayor Philcox <br />NOES: Ma~MMk~ Councilmember Brandes <br />ABSENT: None <br /> <br />Appeal of the City Council to a decision of the Board of Adjustment in appr0.yi~ <br />Application V-77-5 of Darwin Datwyler for a Variance to Sections 2-5.35 and <br />2-5.36(b) of Artic.le 3~ Chapt.~r. 2, Title II of the Ordinance Code of the City <br />of Pleasanton to allow the subdivision of a parcel of land into seven lots, one <br />of which would not have the required street frontage and several others which <br />would not meet the code requirements for minimum lot depth and width~ the <br />property is located between the Arroyo del Valle and the extension of the Del <br />Valle Parkway, s0.utheast of the intersection of the Del Valle Parkwa7 and <br />Harvest Road, the prope~t7 is zoned RM-2000 (Multiple Residential) District <br /> ~yor Philcox declared the public hearing open on this item, and continued to <br />the meeting of May 23, 1977, 8:00 P.M., Pleasanton Council Chambers. <br /> <br />Appeal of Trt-Cities Ambulance, Inc.,. to a decision of the Planning Commission <br />denyin~ a home occupation permit to allow the retention of an ambulance service <br />in a sinSle family residence located at 6264 Guyson Court <br /> Mr. Harris presented his report dated }~y 3, 1977, regarding this matter. <br /> <br /> Mayor Philcox stated that Council had received this date additional signatures <br />to the petition presented earlier in opposition to the Tri-Cities Ambulance opera- <br />tion at 6264 Guyson Court. <br /> <br /> Mayor Philcox declared the public hearing open. <br /> <br /> The following persons spoke in favor of the appeal: <br /> <br /> Robert Lee, 639 Hagamen, Livermore, representing Tri-Cities Ambulance <br /> Betty J.
