and for one unit only, and in addition this action is not a repealer of the earlier schedule set up prior to July 1, 1978, to cover LAVWMA related in- creases and that if this rate schedule is successfully challenged in Court the earlier rate schedule will remain valid, be adopted. The roll call vote was as follows: AYES: Councilmen Brandes, Butler, Kephart, Wood, and Mayor Mercer- NOES: None ABSENT: None Mrs. Marilyn Teitmeyer, new Pleasanton resident, asked for an explanation of Council's actions on this matter. Mayor Mercer detailed the action taken by the Council. Mrs. Teitmeyer suggested the Welcome Wagon ladies be instructed to give new residents all information regarding City Council meetings and pro- cedures. Ms. Betty Rider, 4393 Mirador Drive, stated she felt the sewer service charge was high for a single person living in a residence. Mr. Brown advised Council that reports would be forthcoming regarding Dis- charge Permit for the Cheese Factory and Villa Armando Winery. Council dis- cussion ensued regarding review of all conmercial discharge permits. Council- member Brandes stated he felt they should all be reviewed at one time. Application for Holding Tank Ap.proval for Joe Madden Mr. Campbell presented the report of the Director of Engineering Services dated July 31, 1978, regarding this matter. I{r. Joseph Madden, 3851 Vineyard Avenue, urged Council to consider an alternative method to the high cost of operating Holding Tanks on commercial development for possible increased commercial and industrial development in the City. Councilmember Brandes stated a report was being undertaken regarding the feasibility of discharging holding tank effluent into the Sunol Plant. After discussion, it was moved by Councilmember Brandes, and seconded by Councilm~mber Kephart, that Resolution No. 78-203, approving holding tank on the west side of Old Santa Rita Road requested by Joseph Madden, subject to the following conditions: (1) That the property owner enter into a Standard Holding Tank Agreement with the City prior to issuance of a building permit for this development and execution of this agreement approved by the appro- priate City officials; (2) That the property owners acknowledge in ~iting their understanding of the probable magnitude of monthly pumping charges and that they are able and willing to meet this commitment as long as the holding tank is necessary; (3) That approval be granted for a one-year period; (4) That the property owners acknowledge in ~iting, prior to issuance of a build- ing permit, their understanding of the time limit of this approval and that City Council is not obligated to automatically grant approval for continued use of the holding tank; (5) That the holding tank be pumped out at least one time every fourteen days if monthly volume exceeds 2,000 gallons; (6) That detailed plans showing the location, construction materials and details as well as all other pertinent data concerning this holding tank be submitted to and approved by the Director of Engineering Services prior to issuance of a building permit; and (7) That the capacity of the holding tank be a minimum of 5,000 gallons, be adopted. 8. 8/8/78
