107

Ms. Sue Plotkin, 526 San Gabriel Court, expressed her
appreciation to Council for deciding to consider both matters at
the same time.

Mr. Roush stated that it was his understanding that there is
nothing definitive at this point regarding Hayward's deannexation
of the Ridge. He added that Council's decision not to consider
any proposed development along Foothill Road at this time would
create a conflict with some time requirements in processing
applications. He recommended that the applicants be notified and
find out if they would agree to continue their applications until
the study is completed. Otherwise, Council would have to either
deny the applications without prejudice, initiate a rezoning or
adopt a moratorium.

Mr. Roush stated that he would provide a report on this
matter to the Council at the next meeting.

Mr. Mercer requested Mr. Roush to get more information
regarding the Hayward deannexation of the Ridge.

Item 12d
Request for Interpretation of Permitted Uses at Pleasant Villag~
Center (PUD-S0-15-5D/Tioqa Construction) Concerning Fast Food
Businesses

Mr. Swift presented his report (SR 90:69) regarding the
matter.

Mr. Butler inquired if Recommendation No. 1 would allow the
conditional use only of fast food businesses or of any use.

Mr. Swift replied that this referred only to fast food uses.

Mr. Tarver recalled that the residents expressed concern that
having fast food businesses in the area would bring in more
traffic.

Mr. Roush pointed out that Council could either initiate a
PUD amendment, which would eliminate the possibility of having
fast food uses on the site, or allow fast food businesses only
with a conditional use permit, which would require a public
hearing.

Ms. Mohr stated that since the expectation from the
Initiative was that there would be no fast food uses, then having
a major modification would eliminate that possibility altogether.

-19-
2-20-90
