He stated that after reviewing <br /> the situation, he felt that some changes would be made in the <br /> direction of the proposed revisions. <br /> <br /> Mr. Roush explained that he requested a continuation of the <br /> matter because he wanted to have a closed session with the Council <br /> to discuss the proposed amendments in the context of the lawsuit. <br /> <br /> 7. SPECIAL AND INFORMATION REPORTS <br /> Item 7a <br /> Actions of the Desiqn Review Board, the Board of Adjustment, and <br /> the Planning Commission at Their Meetinqs of May 8, 1990 and <br /> May 10, 1990 <br /> <br /> Mr. Swift presented his report (IR 90:43) regarding the <br /> matter. <br /> <br /> No action was required or taken by the Council on this item. <br /> <br /> Item 7b <br /> Request for Encroachment Permit for Restaurant Use of Public <br /> Sidewalk - De~a Vu Deli and Cafe <br /> <br /> Mr. Swift presented his report (SR 90:203) regarding the <br /> matter. <br /> <br /> Mr. Butler stated that when this issue was first considered <br /> in relation to Strizzi's Restaurant, he pointed out that this <br /> type of use of public property should preserve the City's rights <br /> and outline liabilities. This was accomplished with Strizzi's <br /> through a lease. He said that staff has informed him that in <br /> situations like this, an encroachment permit is more appropriate <br /> than a lease.
