80 <br /> <br /> Mr. McHugh indicated that Golden Eagle Farms received the <br /> white slip from the Department of Real Estate in December of 1989 <br /> to sell lots prior to any improvements being made. <br /> <br /> Mr. Tarver wanted to know if it was disclosed that there was <br /> a condition on those lots for reforestation. <br /> <br /> Mr. McHugh felt that all the proper disclosures were made. <br /> The lots that were sold in 1989 were done so with the intent of <br /> building in the future and buyers were aware that sewer and water <br /> lines were not in. <br /> <br /> Mayor Mercer commented that his understanding is that they are <br /> now trying to sell off lots in order to generate cash to complete <br /> the public improvements. <br /> <br /> Mr. McHugh indicated that is part of the plan. <br /> <br /> Mr. Tarver stated that there was a condition in the approval <br /> that was violated in terms of the subdivision and the sequence in <br /> which these lots were to be sold. <br /> <br /> Mr. McHugh indicated the original concept was to go from south <br /> to north so that access to the City Park would be the first part of <br /> the project completed. Because of the landslide repair operation <br /> and the way the grading went it was necessary to build that project <br /> from north to south and that is where the conflict originated with <br /> those lots on the north and the middle being completed prior to <br /> those on the south. <br /> <br /> Mr. Roush clarified one point regarding Golden Eagles' less <br /> than comprehensive approach to constructing the rest of the public <br /> improvements. Such a plan has yet to be seen by staff so we are <br /> not sure what form that will take. He didn't want home owners to <br /> think that things are all worked out until the plan is received by <br /> public works and engineering because it's a different approach than <br /> has been discussed up to this date. <br /> <br /> Mr. Roush indicated that the City is not holding up the <br /> applications of any property owners who want to begin the process. <br /> Design review, plan checking, etc. are continuing, up to the <br /> issuance of building permits. Building permits will not be issued <br /> until the public improvements issue is resolved. <br /> <br /> Mr. Butler asked that if this application is approved this <br /> evening is there any assurance at all that the improvements that <br /> are required are going to proceed. <br /> <br /> 10-15-91 16 <br /> <br /> <br />
