79 <br /> <br /> Ms. Cathryn Pittinger, 704 Oak Road Avenue, Menlo Park, a <br />property owner of one of the low visibility lots at Golden Eagle, <br />wished to draw Councils attention to Exhibit "A" of the Staff <br />Report as she has opposition to two of the paragraphs. Paragraph <br />5 - "...ensure the goal that the houses blend into the hillside, <br />wooded setting. Particular attention shall be given to reduced <br />height, FAR, massing of the houses, color, roof/siding materials, <br />grading, and landscaping." 6 - "No building permit shall be <br />issued for any houses on Lots 20 through 27, 39 through 38, 45, 48, <br />and 49 of Tract 6033 until the reforestation plan is installed or <br />under way with adequate security." <br /> <br /> Ms. Pittinger stated that the Developer is in Chapter 11 and <br />has not submitted a reorganization plan to the Bankruptcy Court as <br />yet. How long do the property owners have to wait until he posts <br />"adequate security"? Does the City have the right to further delay <br />building permits due to this issue when through City action this <br />reforestation has already been delayed significantly? She further <br />requested that if all the high visibility lots have yet to be sold, <br />could there be special guidelines provided to potential buyers of <br />those lots so they can make informed and educated decisions. Does <br />the City intend to force current lot holders who have expended <br />funds for architectural drawings to down-scale their homes because <br />of City approved delays in the tree plantings? In a very few short <br />years trees planted now will grow to fill the gap and five years <br />from now you won't be able to drive by on 680 and be able to tell <br />whether the trees are five or seven years old. Ms. Pittinger <br />stated she was in favor of the reforestation plan submitted by the <br />developer as long as conditions 5 and 6 are not used to mitigate <br />the delay. She hopes that Council will give these conditions a <br />fair and thoughtful consideration. <br /> <br /> Mr. Butler commented on Ms. Pittinger's suggestion that the <br />City purposely held up the trees being planted. That the trees <br />were not planted was a violation of the conditions that were put on <br />the property, not through City approved delays. <br /> <br /> Mr. Swift stated that Attachment 1 to the conditions resolve <br />the question as to whether the people who bought property will have <br />to pay additional money for landscaping lots. The understanding <br />between staff and the developer is that the developer will pay for <br />the reforestation trees on individual lots. What is going to slow <br />building permits for these lots is not the reforestation plan but <br />the completion of the public improvements, which is a completely <br />separate issue. <br /> <br /> Ms. Mohr indicated that it was her understanding that homes <br />cannot be offered for sale without the Department of Real Estate <br />Public Report having been issued. She wanted to know if there was <br />an awareness of such a thing or were these lots sold without the <br />DRE approval. <br /> <br />10-15-91 15 <br /> <br /> <br />
