Ms. Dennis suggested one of the activities of the community monitor would be to <br />require a re-analysis to be sure it was accurate in preventing the depositing of soil that did <br />not meet the profile in the analysis. <br /> <br /> Mr. Thompson said typically, the analysis was reviewed to see if the material was <br />appropriate for the site, if something in the analysis did not look right, it would be <br />possible for the monitor to ask for reanalysis. Waste Management has done that in some <br />cases. <br /> <br /> Mr. Pico clarified if the community monitor makes recommendations for changes <br />in the procedures, how would those recommendations be enforced. Is there any <br />requirement that forces Waste Management to adopt them. <br /> <br /> Mr. Weinberger said if the issues related to compliance with permit conditions or <br />other regulatory requirements by the agencies mentioned previously, those <br />recommendations could have regulatory force. If they are recommendations for <br />improving satisfactory work at the facility, the item could be brought back to the various <br />public agencies to start to apply persuasion for improved procedures at the facility. Keep <br />in mind also that for the first time there are built in five-year reviews of the operation, so <br />presumably one of the purposes of the five-year review would be to insure that problems <br />that have arisen and not been resolved would be brought before the County in a formal <br />sense with the monitor's recommendation and findings, with action by the Cities if <br />necessary and appropriate to ask the County to add new conditions to the permit or revise <br />the permit conditions if necessary to meet unmet needs the operator has not agreed to. <br />There are a number of forms of persuasion that could be utilized if there is not voluntary <br />compliance. <br /> <br /> Ms. Ayala felt the vigilance of the monitor would be very important for each city <br />and the county. <br /> <br /> Mr. Weinberger said the cities with appointment authority as well as the <br />Recycling Association and Sierra Club will have ongoing opportunity for feedback from <br />the monitor through the designated representative. This is an interactive opportunity and <br />since this is possibly the first monitor at a landfill in the United States, it is a pioneering <br />opportunity to see how a community-based review of the operation of a major industrial <br />facility will allow for local and public input into the operation of the facility. Waste <br />Management has been open to on site, unannounced inspections by the monitor and that <br />is not a concession made at the beginning.
