Frank Lehne, 5466 Foothill Road, Pleasanton, submitted a letter from the Alameda County Land Use Association requesting the Council to withdraw from the MOU. He reiterated the request of Mr. Neu and indicated it would save future strive and legal expenses. There being no further testimony, Mayor Tarver adjourned the continued meeting of the City Council at 7:30 p.m. to meet again in Regular Session on November 7, 1995, at 7:00 p.m., in the City Council Chambers. TOWN HALL MEETING The Town Hall meeting was convened at 7:30 p.m. to discuss the following items: 1. Update of Cooperative Planning Process for San Francisco Bernal avenue Property. 2. Ad3ourn This was a workshop format and no decisions were made. CLOSED SESSION Following the Town Hall meeting, Council adjourned to a closed session to confer with legal counsel regarding potential litigation (eminent domain) involving Chang Su-O Lin concerning the Tassajara Reservoir property; and to confer with legal counsel regarding existing litigation (Alameda County Land Use Association v. City of Hayward). At the enc of the closed session, the City Council reported out that it had voted unanimously to authorize the City Attorney to file a petition for rehearing in the Court of Appeal concerning the City of Hayward matter; if that petition is denied, then the City Attorney is to file a petition for review in the California Supreme Court.
