Item B <br />Restaurant Sewer Loan for the Addition to the Chevy's Mexican Restaurant (SR 95:351) <br /> <br /> Ms. Acosta presented the staff' report. <br /> <br /> Mr. Pico asked what steps have been taken to prevent a future break down in the system <br />where fees are not collected. <br /> <br /> Ms. Acosta indicated there is now an internal auditor to help ensure this situation does not <br />reoccur. <br /> <br /> It was moved by Ms. Michelotti, seconded by Ms. Dennis, to approve the loan for sewer <br />connection fees in the sum of $37,853.37. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers - Dennis, Michelotti, Pico, and Mayor Tarvet <br />NOES: None <br />ABSENT: Councilmember Mohr <br />ABSTAIN: None <br /> <br />MEETING OPEN TO THE PUBLIC <br /> <br /> Martin Inderbitzen, 62 West Neal Street, representing the Lin family, addressed Council <br />regarding the closed session item referring to a potential eminent domain action. If the potential <br />litigation pertains to the Memorandum of Understanding, he would like to talk about that. <br /> <br /> Mr. Roush indicated the closed session item will address the compensation for the <br />reservoir land and the agreement with Dublin San Ramon Services District. He felt it was <br />appropriate for Mr. Inderbitzen to make his comments at this time. <br /> <br /> Mr. Inderbitzen did not believe there was a discrepancy on the compensation for the <br />property. He then gave a brief history of the project. Six to eight years ago the City expressed an <br />interest in building a water tank at a certain elevation, which happened to be on the Lin property. <br />The Dublin San Ramon Services District also expressed a need for a reservoir at a similar <br />location. It was determined in the best interests of all to coordinate the project and formulate a <br />memorandum of understanding for joint operation of the facility. The City received a deed for the <br />property and built the reservoir. There was an amendment to the MOU but Mr. Inderbitzen now <br />wants to implement the MOU. He encouraged Council to move forward with the agreement as <br />he did not know of any reason for conflict. He believed there were monetary savings and <br />efficiencies to be gained. <br /> <br /> Frank Neu, 18210 Carmel Drive, Castro Valley, stated his opinion that the Memorandum <br />of Understanding between Alameda County, Pleasanton and Hayward had been vacated by a <br />acourt decision and asked for Council to place two items on a future agenda: 1) Council <br /> <br />10/24/95 <br /> Page 3 <br /> <br /> <br />
