It was moved by Ms. Dennis, seconded by Ms. Mohr, to introduce Ordinance No. 1650, <br />to be read by title only and waiving further reading thereof, approving the Development <br />Agreement with Signature Properties concerning the Ruby Hill development. <br />The roll call vote was as follows: <br />AYES: Councilmembers- Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Item 7g <br />RequeSt of Signature Properties for park dedication fee credit for providing open space in <br />Ruby Hill for active recreational purposes. (SR95:64) <br /> <br /> Dolores Bengtson presented the staff report. <br /> <br /> Jim McKeehan, Signature Properties, 6612 Owens Drive, indicated that when the <br />property was annexed to the City, it had not been decided whether Signature would dedicate a <br />ten acre site or pay the park fees. Signature had been prepared to do either. Staff ultimately <br />decided it did not want the ten acre site. When the preannexation agreement was negotiated, <br />Signature indicated it would be applying for a credit for park fees. After Signature decided how <br />it would develop its parkland, it submitted an application for a park fee credit. The cost of the <br />park is approximately $4 million. The fees assessed were $2.8 million. The Park and <br />Recreation Commission unanimously approved the request for a credit. Signature believes this <br />credit is equitable since it is building a very nice park and more than 50% of its residents will <br />use that park. The ordinance only permits a 50% credit, which is why Signature is asking for <br />the stated amount. <br /> <br /> Ms. Mohr referred to the staff decision not to accept the ten acres. Did staff indicate <br />where it preferred the site. <br /> <br /> Mr. McKeehan indicated staff wanted a site in the Vineyard Avenue Corridor closer to <br />the City so it would be more centrally located. <br /> <br /> Ms. Mohr inquired of Mr. McKeehan what Signature would do with the twelve acres if <br />the credit is not given. <br /> <br /> Mr. McKeehan indicated it was going to build a park regardless of the Council decision. <br />He believed the credit was due because the ordinance provides for it and Signature is entitled <br />to it. Signature has made it clear from the beginning that it wanted the credit and has met all <br />the criteria. <br /> <br /> Ms. Mohr asked the City Attorney if Council had to give the credit. <br /> <br />02/21/95 <br /> - 22 - <br /> <br /> <br />
