The roll call vote was as follows: AYES: Councilmembers- Ayala, Dennis, Michelotti, Pico, and Mayor Tarver. NOES: None. ABSENT: None. ABSTAIN: None. It was moved by Ms. Dennis, seconded by Ms. Ayala, directing staff to return to Council a final Memorandums of Understanding with the core property owners, proceed with completion of design and processing of permits for the Golf Course Project, and provide recommendations for additional funding during the upcoming Capital Improvement Project review process. Mayor Tarver indicated that he would like to be involved in the discussions regarding the Memorandum of Understanding. 7. MATTERS INITIATED BY COUNCIL Mr. Roush said at the last Council Mr. Pico had questions regarding the e-mail and ex parte communications. He asked if Mr. Pico wanted to discuss this item as an agenda item or as a work shop item? Ms. Acosta understood Mr. Pico wanted the item as an agenda item. Mr. Pico felt it was a significant question about Council policy and procedures and should be held in public and televised. Ms. Michelotti asked if the overall Council policies and procedures would be reviewed. Mr. Pico wanted to discuss the City Attorney's recommendation about ex pane communications while the Council's acting in quasi-judicial roles, such as the proceedings regarding the recent appeals by Mr. Chestnut and Mr. Nelson. He felt significant questions have been raised about due process and protection of appellant' s rights. Ms. Acosta said the item is on the agenda for March 16, 1999.
