comfortable with the megadump proposal. She gave credit to Scott Haggerry for standing up
for his beliefs. She supported him and the lawsuit.

Ms. Michelotti said she has a great deal of respect for Councilmember Dennis's
guidance. But after hearing some of the testimony tonight she did not want to come up short
handed. She wanted 2.1 million tons not anything above that. She does not want to go to other
jurisdictions. She felt the City of Livermore made a good attempt. She did not think the
settlement was good enough. What is the City getting? She was concerned that if this goes back
to the Supervisors, the City might end up with less.

Ms. Dennis said the City of Livermore listened to this issue over a long period of time.
They have been very concerned about the impacts from the beginning. She felt if Pleasanton
did not pull out of the lawsuit, which is a condition of the settlement, then the whole offer will
be withdrawn. She believed the City of Livermore looked at all the issues and voted to pull out
of the lawsuit and felt Pleasanton should support Livermore's decision.

Mr. Weinberger said a number of concerns that this Council has expressed are identical
to those expressed by the Livermore Councilmembers. It was determined that the rate of ffil
for the landfill was sized appropriately for a 160 million ton facility. The Board of Supervisors
left this facility there when the facility was downsized to 80 million. The Livermore City
Council felt a 25 % overall average reduction in truck trips associated with the twenty-five year
period was a community benefit that it did not want to turn down.

Ms. Michelotti asked if it would be appropriate to adjourn to a closed session because
she had some issues she wanted to discuss before taking action on this item?

Mr. Roush said there are closed session issues concerning what will happen if the
settlement proposal is turned down.

The meeting was adjourned to a closed session at 12:40 a.m.

The meeting reconvened at 12:54 a.m.

Pleasanton City Council 36 05119/98
Minutes
