B. Tenant Members. Two (2) members of the PMHC shall be <br />designated by the Pleasanton Mobile Home Owners Association. <br />During the term of this Agreement, the Pleasanton Mobile Home <br />Owners Association agrees that the tenant of each mobile home <br />space within the City of Pleasanton shall be given equal <br />opportunity to participate in its affairs. Fees for membership <br />shall be kept at reasonable rates. <br /> <br /> C. Park Owner Members. Two (2) members of the PMHC shall <br />be Park Owners or their designated representatives. The Park <br />Owners as a group shall designate their two (2) representatives <br />and if they cannot agree upon two representatives, then these <br />representatives shall be designated by lot from among the willing <br />Park Owners. <br /> <br /> D. Fifth Member. The fifth member of the PMHC shall be <br />selected by mutual agreement of the other four members. <br /> <br /> E. Meeting Date. The PMHC shall meet within 45 days of the <br />execution of this Agreement to organize itself, establish a <br />mechanism for keeping minutes of its meetings, establish rules <br />for conducting its business, and determine when it will meet in <br />addition to those meetings required by this paragraph. Copies of <br />the minutes of the meetings shall be distributed as appropriate <br />to the City Manager of the City of Pleasanton, each Park Owner <br />and the Pleasanton Mobile Home Association. <br /> <br /> F. Jurisdiction. The PMHC shall have the power to make <br />non-binding decisions on any matter relative to this Agreement <br />which is not preempted by State law and which is brought to it <br />for resolution by either a Home Owner, a Park Owner, or on its <br />own motion. Its powers shall not include the power to adjust <br />space rent levels, which are to be established by the formula set <br />forth in this Agreement. <br /> <br /> G. Limitation on Authority. In making its decisions, the <br />PMHC shall act in good faith and shall not make any decision <br />which could cause substantive changes in the operation of a park <br />or adversely affect the value of the park. Nothing in this <br />Agreement is intended to abridge the right of the Park Owner to <br />manage his/her park in a reasonable manner. <br /> <br />IV. PETITION PROCESS <br /> <br /> A. Initiation of Petition. The PMHC may be requested to <br />meet on an issue or issues of interest to a Home Owner or Park <br />Owner. The request must be on a petition and does not require <br />any particular number of signatures beyond that of the <br />petitioner. The petition must identify the problems to be <br />addressed by the PMHC and may recommend any solution for <br />consideration of the PMHC members. <br /> <br /> B. Prerequisite to Petition. Any such petition which <br />involves a grievance regarding a specific park may be considered <br />by the PMHC only after the following events have occurred: <br /> <br /> - 4 - <br /> <br /> <br />
