6.68.070 <br />"minister"), from any bona fide church or <br />religious association, provided that: <br />1. The fees, gratuities, emoluments, <br />and profits derived from the extrasensory <br />consulting shall be regulazly accounted <br />for and paid solely to or for the benefit of <br />the bona fide church or religious organi- <br />zation; <br />2. The bona fide church or religious <br />association has submitted proof of tax <br />exempt status to the Police Chief; and <br />3. The minister holding a certificate of <br />ordination from such bona fide church or <br />religious association shall file with the <br />Police Chief a certified copy of the <br />minister's certificate of ordination, and <br />also a form including the minister's name, <br />address, and phone number in the City <br />where the religious ceremony or service <br />involving extrasensory consulting is to be <br />conducted. (Ord. 1770 § 1, 1999) <br />6.68.080 Revocation; Suspension: <br />A. The permit issued by the Police <br />Chief shall be revoked or suspended <br />where it is found that the permittee has <br />been convicted of any offense which <br />would be cause for denial of a Police <br />Department permit upon an original appli- <br />cation, has made a false statement on an <br />application for a Police Department per- <br />mit, or has committed an act in violation <br />of this Chapter. <br />B. The Police Chief shall provide the <br />permittee written notice of intent to re- <br />voke or suspend the Police Department <br />permit thirty (30) days prior to the effec- <br />tive date of the revocation or suspension. <br />The permittee has the right to request a <br />hearing regazding the proposed revocation <br />or suspension by sending written notice to <br />the Police Chief within ten (10) days of <br />the date of the notice. The Police Chief <br />shall schedule such a hearing within fif- <br />teen (15) days of receipt of the request, <br />and shall issue a written decision within <br />five (5) days of the hearing. <br />C. The permittee has the right to ap- <br />peal the decision of the Police Chief to <br />the City Manager. A request for hearing <br />by the City Manager shall be filed by the <br />permittee with the City Clerk within ten <br />(10) days of the date of the Police Chief's <br />written decision. A hearing on the appeal <br />shall be held before the City Manager, or <br />his or her designee, within ten (10) days <br />of filing of the request for appeal. The <br />City Manager, or his or her designee, <br />shall issue a written determination <br />regazding the appeal within five (5) days <br />of the hearing. (Ord. 1770 § 1, 1999) <br />6.68.090 Inspection: <br />The Police Department shall, from time <br />to time, make an inspection of each extra- <br />sensory consulting establishment for the <br />purpose of determining compliance with <br />this Chapter.
