Commissioner Maas suggested the phrase "unable to comply." Commissioner Blank suggested that those terms be defined more specifically to curb potential abuse. Mr, Roush noted that could be done and noted that there would be an appeal process. Chairperson Arkin suggested that the IS-day appeal process be relaxed during the holidays. Page 19B There were no comments. Page 20B Commissioner Pearce suggested that the word "aggrieved" be removed from the appeal section, to be replaced with "any applicant or person." There was consensus from the Commission to make that change. Commissioner Maas noted that she was not ready to make this mandatory but would vote "aye" on this motion. She wanted to ensure that the SO points are truly attainable. She added that she was not entirely convinced that the longer-term savings of green building practices were better than immediate, upfront savings for builders, She expressed concern for the buyers if the prices went up because of green building measures. Chairperson Arkin believed this amendment provides predictability for the developers and that he would support it. Commissioner Roberts moved to find that the proposed amendment to the Municipal Code is statutorily exempt from CEQA and to adopt a resolution recommending approval of PRZ-13 to the City Council, as shown in Exhibit B, including all comments made by the Planning Commission.
