Any aggrieved atillpplicant or person may appeallhe detcrmination of the Green Building Compliance Official regarding: (i) the granling or denial of an exemption pursuant to Section 17.50.080; (ii) compliance with the ordinancc pursuant 10 Section 17.50.070; or (iii) the type or scope of mitigation mcasures required for noncompliancc pursuant to Scction 17.S0.070(d)(3). b. I\ny appcal Appeals must be filcd in writing with the City Manager within fifteen (IS) days oflhe determination by thc Green Building Compliancc Official. The appcal shall state the alleged crror or rcason for the appcal. In reviewing the appeal, the City Manager may request additional writtcn or oral information from the aApplicant or the Green Building Compliance Official. Thc City Manager shall issuc a writtcn dctermination within fifteen (IS) days of the receipt ofthc appcal. c. The determination by the City Manager may be appealed to the City Council by filing a written appeal with the City Clerk within fil1een (15) days of the written determination by thc City Manager. The City Council shall hold a public hcaring regarding the appeal within forty (40) days ofthc date when the appeal was tiled. 17.50.100 Enforcement. a. Violation of any provision of this Chapter due to thc aApplicant's failure to build the eCovered pfroject in accordance with the eCovered p'p'rojecl's plans, including the pr.re-p'p'ermitting dDocumentation and the conditions of approval in the applicable permit, shall be punishable as provided in Chapter 1.28 of the Plcasanton Municipal Code. b. Where the aApplicant has violated any provision of this Chapter due to the aApplicant's failure to build the eCovered pr.roject in accordance with thc project's plans, including the p'p're-p'p'ermitting dDocumentation and thc conditions of approval in 22B
