C. Suppression Employees Overtime Record.' <br /> <br />The Fire Department shall provide the current overtime selection factor for each suppression employee <br />per the on-line records management system. <br /> <br />D. Rank-for-Rank Overtime: <br /> <br />The Authority agrees that for any absence, it will assign overtime on a rank-for-rank basis. If there is no <br />one available through the pre-scheduling system, then mandatory overtime within the rank will be <br />utilized. In the event that an individual of equal rank is not available to be mandated to fill the position, <br />then a pre-signed up qualified actor will be used. In the case of an emergency and an officer and/or fire <br />engineer is unable to be contacted, an acting assignment may be used to fill these ranks. The procedures <br />pertaining to the selection of an employee for acting officer position shall be followed. (See Section 23 <br />of this M.O.U.) <br /> <br />Section 8. Department Related Court Time <br /> <br />Employees who are required to report to work during their off-duty time for the purpose of appearing in <br />court shall be compensated at the eight (8) hour overtime rate, provided that such compensation be no <br />less than three (3) hours for court appearances in the Livermore-Pleasanton Judicial District and four (4) <br />hours for court appearances outside the Livermore-Pleasanton Judicial District. <br /> <br />Section 9. Holiday Pay <br /> <br />Fifty-six (56) hour workweek employees shall be compensated for working holidays each year through <br />receipt of holiday in lieu pay. This compensation shall be seven and one-half percent (7-1/2%) of the <br />employee's base salary at time of payment, plus special compensation as defined by PERS; except PERS <br />FLSA overtime, uniform allowance, Paramedic pay, EPMC, and exclusive of any overtime. Such <br />compensation shall be paid in two installments. Such payments are to be made on the first payday after <br />December 1 and the first payday after June 1. <br /> <br />Employees shall receive prorated holiday pay upon termination. <br /> <br />The following holidays will be observed for employees in the classes of Fire Inspector, Hazardous <br />Materials Coordinator and Hazardous Materials Inspector: <br /> <br /> 1. New Year's Day <br /> 2. Martin Luther King, Jr. Day (third Monday of January) <br /> 3. President's Day (third Monday of February) <br /> 4. Memorial Day (last Monday of May) <br /> 5. Independence Day <br /> 6. Labor Day (first Monday of September) <br /> 7. Veterans' Day <br /> 8. Thanksgiving Day <br /> 9. Day following Thanksgiving <br /> <br /> 10 <br /> <br /> <br />
