I N C O A V O A A i ~ D <br />II. SCOPE <br />A. The "Covered Area". <br />The geographic boundary of the GHAD is shown on the site plan attached to this Plan of Control <br />as Exhibit "A". The property which is to be maintained by the GHAD will be known as the <br />"Covered Area," and includes the following: <br />1. Open space (as that term is defined in Section C, below), including hillside slopes, where <br />a geologic hazard of the type addressed by the GHAD (see Section D, below) occurs or <br />could occur to the extent that improvements within the GRAD could be adversely <br />impacted. <br />2. A Lot or Lots which have been adversely impacted by a geologic hazard of the type <br />addressed by the GHAD, where the hazard begins outside the Lot boundaries and where <br />the hazard was not caused by an act(s) or omission(s) of a Lot owner, or owner's agent, <br />contractor or representative. <br />The Covered Area excludes, and the GHAD will not maintain or be liable for, the following: <br />1. Hillside slopes located within a Lot. <br />2. Individual Lots where the geologic hazard(s) was caused by an act(s) or omission(s) of a <br />-- Lot owner, or owner's agent, contractor or representative, whether the geologic hazard(s) <br />began outside the Lot boundaries and terminated inside the Lot boundaries, or whether <br />the geologic hazard(s) began and terminated inside the Lot boundaries. <br />4291-W2 <br />July 17, 1997 <br />__ Revised October 9, 1997 <br />Revised October 22, 1997 3 <br />
