I N C O A V O A A i ~ D II. SCOPE A. The "Covered Area". The geographic boundary of the GHAD is shown on the site plan attached to this Plan of Control as Exhibit "A". The property which is to be maintained by the GHAD will be known as the "Covered Area," and includes the following: 1. Open space (as that term is defined in Section C, below), including hillside slopes, where a geologic hazard of the type addressed by the GHAD (see Section D, below) occurs or could occur to the extent that improvements within the GRAD could be adversely impacted. 2. A Lot or Lots which have been adversely impacted by a geologic hazard of the type addressed by the GHAD, where the hazard begins outside the Lot boundaries and where the hazard was not caused by an act(s) or omission(s) of a Lot owner, or owner's agent, contractor or representative. The Covered Area excludes, and the GHAD will not maintain or be liable for, the following: 1. Hillside slopes located within a Lot. 2. Individual Lots where the geologic hazard(s) was caused by an act(s) or omission(s) of a -- Lot owner, or owner's agent, contractor or representative, whether the geologic hazard(s) began outside the Lot boundaries and terminated inside the Lot boundaries, or whether the geologic hazard(s) began and terminated inside the Lot boundaries. 4291-W2 July 17, 1997 __ Revised October 9, 1997 Revised October 22, 1997 3
