Juniper Bay Road <br />Somers, MT 59932 <br /> <br />January 2, 2002 <br /> <br />Dear Mr. And Mrs. Bach, <br /> <br />This letter is in response to your letter of September 18, 2001 to Bob Williams regarding <br />your interaction with Greenbriar Homes during the construction of North Sycamore <br />Specific Plan improvements and the relocation of Sycamore Road in Pleasanton. <br />You had raised a number of issues in that letter and Bob and I have been trying to <br />determine the disposition of each of them. We are scheduled to go to City Council on <br />January 15th to accept North Sycamore Specific Plan improvements and would like to <br />have as many of these items resolved as possible. Greenbriar will still be responsible to <br />complete in-tract improvements that will go to City council later this year. <br /> Listed below is my understanding of the issues you've raised and the current disposition <br /> of each issue: <br /> <br /> J2 $27,000 Payment - It is my understanding that the $27,300 was to compensate for <br /> private driveway construction. Greenbriar had agreed to fund the building of a <br /> common driveway serving the Bach and Bozorgzad properties. The developer <br /> had agreed to set aside in an escrow account, $27,300 towards the Bach portion of <br /> that driveway construction. The driveway was ultimately constructed by Mr. <br /> Bozorgzad and is now complete, issue is considered <br /> res61ved. <br /> <br /> 2. Grant of Easement - Greenbriar had secured approval for an easement for utility <br /> purposes at the front of the Bach property. Utility equipment was subsequently <br /> located across the road from the Bach property and consequently the easement <br /> was no longer required. The grant of easement document was never executed nor <br /> recorded. The original document is enclosed. This issue is considered resolved. <br /> <br /> 3. Bathroom floor damage - The developer has produced a cancelled check for the <br /> amount of $400 for the stated purpose.
