The Project would provide 52 above-moderate <br />income residential units, which is 52 more above-moderate income units than <br />projected. However, the inventory of sites provides a buffer of 56 units in excess of <br />the City’s assigned 894-unit moderate-income regional housing needs allocation <br />(RHNA). As a result, the approval would not require re -zoning of additional sites to <br />meet the moderate income RHNA. <br /> <br />Section 5: Findings for Vesting Tentative Map 8749 <br />State law and the Zoning Ordinance of the PMC set forth the considerations to be <br />addressed in reviewing a Vesting Tentative Map. The Planning Commission makes the <br />following findings that Vesting Tentative Map 8 749 conforms to the purposes of the <br />PMC: <br /> <br />1. The proposed vesting tentative subdivision map conforms to the zoning <br />regulations/development plan. <br />The Vesting Tentative Tract Map and improvements conform to the Design Review <br />development plan and site development standards of P23-0563. The map and <br />improvements, therefore, would conform to the underlying Public and Institutional <br />zoning district and HOZ. <br /> <br />2. The design of the subdivision provides, to the extent feasible, for future <br />passive or natural heating or cooling opportunities. <br />As approved and conditioned in the Design Review development plan, the <br />condominiums in the project will comply with the City’s residential Green Building <br />Ordinance, Climate Action Plan 2.0, and the State’s Title 24 Building Energy <br />Efficiency Standards, and would be required to incorporate a series of renewable <br />energy design and energy efficiency features . <br /> <br />3. The proposed vesting tentative subdivision map, together with its design and <br />improvement, is consistent with the Pleasanton General Plan. <br />P23-0563 is found to be consistent with the Pleasanton General Plan and Vesting <br />Tentative Map 8749 was submitted based on the proposed development plan. The <br />proposed subdivision and its improvements are compatible with the applicable <br />objectives, policies, land uses, and programs specified in the General Plan. <br /> <br />4. The subdivision site is physically suitable for this type and density of <br />development. <br />The property is not in a flood zone or earthquake fault zone and is relatively flat. <br />Project construction would involve minimal site grading and alteration of existing <br />topography. Thus, the project site is physically suitable for the proposed <br />development. <br /> <br />5.
