Resolution No. PC-2025-24 <br />Page 2 <br /> <br />Section 2: Finds that the proposed project qualifies for a statutory exemption from <br />California Environmental Quality Act (CEQA) and does not fall under any of the <br />exclusion criteria per Public Resources Code Section 21080.66. <br />Section 3: The Project is consistent with the allowable land uses and residential <br />densities set forth in the General Plan and in the 6th Cycle Housing Element, which <br />designate this site for housing at between 39 and 66 units per acre, within which the <br />proposed project densities would fall. As such, the Project complies with the <br />requirements of Government Code Section 65860 regarding zoning consistency with <br />the General Plan. <br /> <br />Section 4: Findings for Housing Site Compliance Review (P23-0563). <br />The Planning Commission finds that the project would conform to all applicable <br />Objective Design Standards (ODS) with 51 or more residential units and related <br />environmental mitigation measures, Pleasanton Municipal Code (PMC), Zoning <br />Ordinance and other adopted standards, with the exception of items for which a <br />concession or waivers have been requested by the applicant and granted in accordance <br />with provisions of California Density Bonus law at Cal. Government Code §65915. <br /> <br />The Planning Commission finds that the following findings are met: <br /> <br />1. The project complies with the requirements of the ODS and any other <br />applicable objective standard established with adopted City plans and <br />documents; <br />The purpose of the ODS is to ensure projects will be compatible with their <br />surroundings, attractively designed and landscaped, and minimize impact to <br />aesthetic resources. As detailed in the November 12, 2025, Planning Commission <br />agenda report, the project complies with the applicable ODS for Housing Sites and <br />objective standards in the PMC, with the exception of items for which concessions <br />and/or waivers have been granted pursuant to State Housing Density Bonus Law; <br />and the Climate Action Plan. <br /> <br />2. The project complies with mitigation measures of any applicable <br />environmental document; <br />Pursuant to CEQA Guidelines Public Resources Code Section 21000, et seq., an <br />Environmental Impact Report (EIR) was certified and a Mitigation Monitoring and <br />Reporting Program (MMRP), was adopted by the City of Pleasanton (City) on <br />January 26, 2023 (City of Pleasanton 2023-2031 (6th Cycle) Housing Element <br />Update Program Final EIR, SCH No. 2022040091). As described in Section 2, the <br />project is statutorily exempt from further CEQA review under Public Resources <br />Code Section 21080.66 <br /> <br />3. Findings Pursuant to Government Code Section 65863 (No Net Loss) <br />The proposed project would include 50 above-moderate income residential units <br />and nine on-site affordable units (seven Low-Income and two Very Low-Income); in <br />comparison, the inventory of sites included in the 6th Cycle Housing Element <br />Docusign Envelope ID: 52DE2131-F0C9-4C18-86DD-6B9E7ADA8792
