This survey shall be conducted
no more than 7 days prior to initiation of
demolition/construction activities during the
early part of breeding season (February 1
through April 30), and no more than 30 days
prior to initiation of these activities during
the latter part of the breeding season (May
1 through August 31). If nesting raptors or
migratory birds are detected on the project
site during the survey, a suitable
construction-free buffer will be established
around all active nests. Precise dimensions
of the buffer (up to 250 feet) would be
determined at that time and may vary
depending on location and species. Buffers
will remain in place for the duration of
breeding season or until it has been
confirmed by a qualified Biologist that all
chicks have fledged and are independent of
their parents. Pre-construction surveys
during nonbreeding season are not
necessary, as birds are expected to abandon
their roosts during construction activities.
Implementation of the above measures
would mitigate impacts to tree-nesting
raptors and other migratory birds to a less
than significant level.
Specific East Alameda County Conservation
Strategy Avoidance and Minimization
Measures for the golden eagle
Although nesting habitat is marginal on the
development site and its proximity, in the
unlikely event that an eagle did nest on the
project site, the following mitigation would
