<br />Subject: Arroyo Lago Residentfal Project Comment Letter <br />Elder Abuse – for elder residents of Ironwood under California Penal Code § 368 PC. <br />Dear Mayor, City Council Members, City Manager, et. al. <br />Penal Code § 368 PC defines elder abuse in California as the physical or emotfonal abuse, neglect, or <br />financial exploitatfon of a victfm 65 years of age or older. Note that the average age of Pleasanton <br />Residents along the East Wall of the Village at Ironwood is 76 Years old. Even if there were not such a <br />code, the issues would undoubtedly be harmful to elderly Pleasanton residents and would continue to <br />be so for years! <br />Example Conditions: <br />Resident Age: The average age of residents along the East Wall of the (55+) Village at Ironwood is about <br />76 (and getting older), while for the Ironwood Garden Community is in the 70’s. I myself am over 76 <br />years old. Many residents of the Ironwood communitfes suffer from age-related issues such as difficulty <br />in walking, sight impairment, parkinsonism, recent surgeries causing slow movement, etc. which is <br />mitfgated by spending quality quiet tfme outdoors in sunlight when possible. Hearing issues are <br />exacerbated by constructfon noise of earth moving equipment, building processes, etc. and increased <br />traffic when using common electric scooters for transportatfon. These would impact physical as well as <br />emotfonal well-being. Susceptfbility to contaminants such as dust is notably exasperated with aging <br />residents. <br />Emotfonal abuse or fear / anxiety: Existfng residents are already exhibitfng emotfonal anxiety and <br />distress at the possibility of the ruin of their peaceful lifestyle which was expected and purchased in the <br />Ironwood communitfes. Their ability to relax in the sun is feared to be eliminated, and rightiully their <br />expectatfon would come to pass. Just the thought of such mental anguish and disturbing atmosphere <br />within several feet of their property is stressful and emotfonally harmful. The actual constructfon, <br />environmental dust / contaminant pollutfon and land disturbance / movement and drainage issues and <br />invasion of privacy would certainly cause distress and potentfal mental harm. Close proximity <br />constructfon noise, ground shaking, unavoidable invasion onto existfng Village property by overfly <br />constructfon materials and soil, could likely disrupt sleep patterns of the elderly. <br />Physical Abuse: The inevitable increases in traffic and related accidents, noise and hearing impairment, <br />lower quality of breathable-air due to constructfon are obvious. As depicted in the figure below, the <br />proposed development with such small setback and raised land elevatfon, pose threat of accidental <br />physical invasion from new backyards into the existfng Village back areas. Note that additfonal enclosed <br />patfos would decrease the stated setback. There is a danger of possible rupture of the 6 ft raised land on <br />the new lots possibly from earthquakes or other ground movement from weakened retaining wall and <br />failing soil fill during constructfon, or later, causing encroachment of landfill into existfng Village <br />backyards and possible physical harm. <br />Financial Abuse: Loss of home value will likely result from decrease in property sales values for those <br />near the proposed development because of the tremendous loss of enjoyable locatfon and increase <br />undoubtedly in noise from such close neighbors, both children and adults.
