Ordinance No. 2296 <br />Page 12 of 12 <br />Failure to repair or replace a failed or faulty BPA; <br />4. Any unprotected direct or indirect connections have been made between <br />the City's water system and a sewer line, system, or equipment containing <br />contaminants; <br />5. Any other type of connection to the City's water system where the <br />required BPA has been removed or bypassed; and <br />6. Any other circumstances presenting an immediate health hazard to the <br />City's water system. <br />B. Any corrective measures required to maintain the customer's water service shall <br />be at the sole cost of the customer. <br />C. Water services shall not be restored until: <br />1. The customer has demonstrated compliance with the requirements as set <br />forth in this chapter to the satisfaction of the City; and <br />2. The City has received reimbursement for any costs incurred by the City to <br />enforce the requirements of this chapter. <br />§ 14.16.070. Violations Deemed a Public Nuisance <br />A. In addition to any other remedies provided in this chapter, any condition caused or <br />permitted to exist in violation of this chapter is a threat to the public health, safety and <br />welfare, and is declared and deemed a nuisance. Such condition may be summarily <br />abated and/or restored by an authorized city representative to compel the cessation of <br />such nuisance. <br />B. The cost of such abatement and any resulting restoration shall be borne by the <br />responsible person for the premises, and the cost thereof shall be a lien upon and against <br />the property. The procedures of Chapter 1-9.28.160 of the Pleasanton Municipal Code <br />shall be followed for any such lien. <br />C. The City reserves the right to seek enforcement by civil action for any violation of <br />this Chapter. In any such action, the City may seek and the court shall grant, as <br />appropriate, any or all of the following remedies: <br />A temporary and/or permanent injunction; <br />2. Any costs incurred by the City including but not limited to the cost of <br />investigation, inspection, and monitoring, as well as reasonable costs of <br />preparing and bringing legal action; and <br />3. Any other costs incurred by the City to abate the nuisance. <br />
