<br /> <br /> <br /> <br /> <br /> <br />MEMORANDUM <br /> <br />Date: April 23, 2025 <br /> <br />To: Chair and Members of the Planning Commission <br /> <br />From: Ellen Clark, Director of Community Development <br /> <br />Re: April 23, 2025 – Agenda Item 6: P23-0480 & Vesting Tentative Map 8680, 3300 <br />Busch Road <br /> <br /> <br /> <br />Since publication of the April 23, 2025 Agenda Report, there has been further discussion <br />between the City and the applicant with respect to Condition of Approval 143, regarding timing <br />for construction of the intersection improvements at Valley Avenue / Santa Rita Road. <br /> <br />In particular, the applicant was concerned that tying issuance of building permits to completion <br />of the improvements would negatively impact their ability to develop the project, which is <br />intended to be marketed to homebuilders for sale in several phases (a common practice with <br />projects of this type and scale). Conversely, the City was concerned that adequate assurance <br />be provided that the improvements would be completed in a timely manner. <br /> <br />The applicant and staff have agreed to the following amended language to COA 143: <br /> <br />143. SANTA RITA ROAD AND VALLEY AVENUE IMRPROVEMENTS: The Project <br />shall construct improvements to the Santa Rita Road/Valley Avenue intersection which <br />shall include the widening of the intersection to include a third southbound left turn lane, <br />a second westbound left turn lane, and the extension of the westbound left turn pockets <br />(“Santa Rita Road/Valley Avenue Improvements”). As a condition precedent to approval <br />of the final map, the City and the applicant shall enter into a subdivision improvement <br />agreementan offsite improvement agreement, subject to the city’s bonding <br />requirements, for the completion of the Santa Rita Road/Valley Avenue Improvements. <br />The Santa Rita Road/Valley Avenue Improvements shall be completed prior to the <br />earlier of the following: 1) the issuance of the 300th dingle-family residential building <br />permit, orno later than 2) three years from after the date of approval of the final map.the <br />date of execution of the Subdivision Improvement Agreement. The Santa Rita <br />Road/Valley Avenue Improvements shall be eligible for a fee credit in accordance with <br />Pleasanton Municipal Code Section 3.26.070.
