<br />added Chapter 13.1 (commencing with Section 42652) to Part 3 of Division 30 of the California Public Resources 398
<br />Code, establishing methane emissions reduction targets in a statewide effort to reduce emissions of short-lived 399
<br />climate pollutants as amended, supplemented, superseded, and replaced from time to time. 400
<br />For the purposes of this Agreement, SB 1383 specifically refers to the Short-Lived Climate Pollutants (SLCP): Organic 401
<br />Waste Reductions regulations developed by CalRecycle and adopted on November 3, 2020 that created Chapter 12 402
<br />of 14 CCR, Division 7 and amended portions of regulations of 14 CCR and 27 CCR. 403
<br />“Services” mean all obligations of Contractor under and in accordance with this Agreement to the City. 404
<br />“Single-Family Dwelling” or “Single-Family” means any detached or attached house or residence designed or used 405
<br />for occupancy by one (1) family, provided that Collection service feasibly can be provided to such premises as an 406
<br />independent unit, and the owner or occupant of such independent unit is billed directly for the Collection service. 407
<br />Single-Family includes Residential units of a duplex, triplex, or fourplex Residential structure provided that each unit 408
<br />is separately billed for their specific service level. 409
<br />“Solid Waste” means all putrescible and non-putrescible solid, semisolid, and associated liquid waste, including 410
<br />garbage, trash, refuse, paper, rubbish, ashes, industrial wastes, discarded home and industrial appliances, 411
<br />dewatered, treated or chemically fixed sewage sludge which is not a Hazardous Waste, special waste, manure, 412
<br />vegetable or animal solid and semi-solid wastes, and other discarded solid and semi-solid wastes, which the City 413
<br />Municipal Code requires Generators within the City to set out for Collection. Solid Waste does not include the 414
<br />following: 415
<br />1) Materials set out for Collection in a Container, which is specifically designated for Recyclable Materials 416
<br />or Organic Materials; 417
<br />2) Hazardous Waste; 418
<br />3) Radioactive waste; 419
<br />4) Infectious Waste provided that Infectious Waste, whether treated or untreated, is not Disposed of at a 420
<br />Solid Waste facility; and, 421
<br />5) Abandoned automobiles. 422
<br />“Source Separated” means the segregation from Solid Waste, by the Generator, of materials designated for separate 423
<br />Collection for some form of materials Recovery or special handling. 424
<br />“Special Tipping Fee Review” means an adjustment to the Tipping Fee(s) in addition to or at a time other than when 425
<br />periodic adjustments of the Tipping Fee(s) are made under this Agreement pursuant to Section 8.5. 426
<br />“Standard Industry Practice” means (i) the then-current development and operations practices and standards of the 427
<br />northern California Solid Waste and materials management industry with respect to collection, transfer, transport, 428
<br />processing, diversion, and disposal services; and, (ii) the then-current development, operations, closure, and post-429
<br />closure practices and Solid Waste Association of North America (or any successor organization) Manager of Landfill 430
<br />Operations Standards in meeting Contractor’s obligations under this Agreement. 431
<br />“State” means the State of California. 432
<br />“Subcontractor” means a Party who has entered into a contract, express or implied, with Contractor for the 433
<br />performance of an act on Contractor’s behalf that: (i) involves Accepting, Processing, Diverting, Marketing, Residue 434
<br />Disposal, and/or other handling of the Recyclable Materials; and, (ii) is necessary for Contractor’s fulfillment of its 435
|
