<br />“Recovered Material” means materials which have been Recovered from Recyclable Materials through Processing 354
<br />activities. 355
<br />“Recovered Materials Revenue Payments” means the money paid by Contractor to the City on a quarterly basis 356
<br />representing the City’s share of the revenues Contractor receives from the Marketing of the Recovered Materials 357
<br />resulting from the Processing of Recyclable Materials. 358
<br />“Recyclable Materials” means newspaper, cardboard, mixed color paper, white paper, junk mail, magazines, 359
<br />telephone books, paper bags, cereal and food boxes, egg cartons, plastic bottles and containers labeled #1-7, plastic 360
<br />milk containers, detergent containers, clear, brown, and green food and beverage container glass, cans of aluminum, 361
<br />steel, tin, food cans, empty aerosol cans, pipe tins or other materials having economic value contained within a Load 362
<br />of Recyclable Materials which have been separated from Solid Waste and Organic Materials prior to Collection, and 363
<br />may also include any other type of Recyclable waste material agreed on by the Parties. Recyclable Materials do not 364
<br />include Unpermitted Materials, Excluded Materials, or other Franchised Materials. Recyclable Materials are the 365
<br />materials listed in Exhibit D that may be replaced by a list posted by the City in their sole discretion from time to 366
<br />time and provided to Contractor. 367
<br />“Recycled” or “Recycling” (or other variations thereof) means the treating or reconstituting materials that are or 368
<br />would otherwise be Disposed of and returning them to the economic mainstream in the form of raw material for 369
<br />new, reused, or reconstituted products. Recycling includes processes deemed to constitute a reduction of landfill 370
<br />Disposal pursuant to 14 CCR, Division 7, Chapter 12, Article 2. Recycling does not include the use of Franchised 371
<br />Materials for gasification or transformation as defined in Public Resources Code Section 40201. 372
<br />“Residential” means of, from, or pertaining to a Single-Family premises or Multi -Family p remises including Single-373
<br />Family homes, apartments, condominiums, townhouse complexes, mobile home parks, and cooperative 374
<br />apartments. 375
<br />“Residue” means materials that remain after Acceptance, Processing, and Diversion of Recyclable Materials, which 376
<br />may not be Recovered, and which subsequently require Disposal. 377
<br />“SB 54” means the Plastic Pollution Prevention and Packaging Producer Responsibility Act approved by the Governor 378
<br />of the State of California on June 30, 2022, which amended Section 41821.5 of the California Public Resources Code 379
<br />to add Chapter 3 (commencing with Section 42040) to Part 3 of Division 30, as amended, supplemented, superseded, 380
<br />and replaced from time to time. For the purposes of this Agreement, SB 54 includes any implementing regulations 381
<br />developed by CalRecycle, as amended supplemented, superseded, and replaced from time to time. 382
<br />“SB 343” means the Environmental Advertising: Recycling Symbol: Recyclability: Products and Packaging Senate Bill 383
<br />approved by the Governor of the State of California on October 5, 2021, which amended Sections 17580, 17580.5 of 384
<br />the California Business and Professions Code, and amended Sections 18015 and 42355.5 of, and added Section 385
<br />42355.51 to, the California Public Resources Code, relating to environmental advertising, as amended, 386
<br />supplemented, superseded, and replaced from time to time. For the purposes of this Agreement, SB 343 includes 387
<br />any implementing regulations developed by CalRecycle, as amended, supplemented, superseded, and replaced from 388
<br />time to time. 389
<br />“SB 1016” means Senate Bill 1016 approved by the Governor of the State of California on September 26, 2008, which 390
<br />amended Sections 40183, 40184, 41783, 41820.6, 41821, 41850, 42921, and 42926 of, amended the headings of 391
<br />Article 4 (commencing with Section 41825) and Article 5 (commencing with Section 41850) of Chapter 7 of Part 2 of 392
<br />Division 30 of, added Sections 40127, 40145, 40150.1, 41780.05, 42921.5, and 42927 to, and repealed and added 393
<br />Section 41825 of, the Public Resources Code, relating to Solid Waste, as amended, supplemented, superseded, and 394
<br />replaced from time to time. 395
<br />“SB 1383” means Senate Bill 1383 of 2016 approved by the Governor of the State of California on September 19, 396
<br />2016, which added Sections 39730.5, 39730.6, 39730.7, and 39730.8 to the California Health and Safety Code, and 397
