Page 1 of 3 <br />Item #8 <br /> CITY COUNCIL AGENDA REPORT <br /> <br />January 21, 2025 <br />Library and Recreation <br /> <br />TITLE: INTRODUCE AND WAIVE THE FIRST READING OF AN ORDINANCE UPDATING <br />THE PLEASANTON MUNICIPAL CODE, CHAPTER 13.08, TO ADDRESS <br />UNAUTHORIZED USES OF PARKS AND RECREATION FACILITIES <br /> <br />SUMMARY <br />This staff report provides background information and a recommendation to update the <br />language of the Pleasanton Municipal Code Section, Chapter 13.08, to ensure that smaller <br />sports groups follow the same rules as the larger sports groups when utilizing the City’s parks <br />and recreation facilities. At its November 14, 2024, meeting, the Parks and Recreation <br />Commission reviewed the draft, received feedback, and approved a motion to recommend the <br />City Council approve the proposed updates to the Municipal Code. <br /> <br />RECOMMENDATION <br />Introduce and waive the first reading of an ordinance updating the Pleasanton Municipal Code, <br />Chapter 13.08, to address unauthorized uses of parks and recreation facilities. <br /> <br />BACKGROUND <br />Chapter 13.08 of the Pleasanton Municipal Code provides rules and regulations on the use of <br />the City’s parks and recreation facilities. The intention of these rules and regulations is to <br />protect the public health, safety, and general welfare of the residents of the City and users of <br />City facilities. In recent years, there has been a rise in the unauthorized use of park and <br />recreation facilities by organized sports clubs and private athletic training groups. <br /> <br />Though the use of these facilities was not authorized by the City, the Municipal Code does not <br />prohibit this unauthorized use. Accordingly, City staff recommends amending various sections <br />of the Pleasanton Municipal Code, as described in Attachment 1, to address the use of its <br />facilities by these often smaller unauthorized groups. <br /> <br />On November 14, 2024, the Parks and Recreation Commission voted 4-1 to recommend the <br />updates to Municipal Code Chapter 13.08 as described in Attachment 1. Commissioner <br />Vickers did not support the updates due to concerns over enforcement. Currently, when staff <br />are made aware of unauthorized users, contact is made with the group, and information on the <br />rental process is provided. There have been no issues with this process. This same process <br />would be used to enforce these updates. <br /> <br />DISCUSSION <br />Currently, the Municipal Code does not prohibit the unauthorized use of the City’s parks and <br />recreation facilities for groups under 25 people. With the advent of small, privatized youth <br />sports clubs and various private athletic training groups, portions of the Municipal Code are no <br />longer effective in ensuring smaller groups are required to obtain field use permits, pay <br />associated fees, and maintain adequate insurance policies in order to use City facilities.
