• The artwork contains an image of a person, who appears to be a minor, in <br />sexually suggestive dress, pose or context. <br />• The artwork or any information is directly adverse to the commercial or <br />administrative interests of LAVTA or is harmful to the morale of LAVTA <br />employees and LAVTA's Operations and Maintenance Contractor. <br />• The artwork contains images or information that demean an individual or group of <br />individuals on account of race, color, religion, national origin, ancestry, gender, <br />age disability or sexual orientation. <br />• The artwork contains images or information that are violent, frightening or <br />otherwise disturbing as to be harmful to minors. <br />• The artwork promotes escort service, dating service, or sexually oriented <br />business. <br />• The artwork contains images or information that would be deemed by a <br />significant segment of the public to be offensive, improper, or in bad taste. <br />• The artwork promotes the use of alcohol and/or tobacco products. <br />• The artwork contains political information or local or national controversial <br />subject or subjects not in accordance with the Statutes, Ordinances and court <br />decisions pertaining to the LAVTA service area. <br />• Prior to displaying the Art, as set forth below in section 3, the City shall submit <br />the final Art to LAVTA's Director of Marketing & Communications, for approval. <br />LAVTA shall have the absolute right to disapprove for any reason any Art. <br />3. Display of Art. LAVTA at its sole cost, shall display the Art at the location(s), in a <br />manner as prescribed by the LAVTA. The Art shall be displayed in a manner so as not to <br />interfere with the LAVTA's primary purposes for providing the safe and orderly flow of <br />transportation vehicles and pedestrian traffic as determined exclusively by the LAVTA. <br />Furthermore, LAVTA shall limit the number of Art to be displayed on the Property based on <br />available space. The LAVTA anticipates that the Art may be displayed for a period of up to <br />five (5) years. <br />4. Removal of Art. If the Art is damaged or defaced, the LAVTA will remove the damaged <br />or defaced Art without prior notification to the City, if in the opinion of the LAVTA any <br />damaged Art may cause injury or damage to persons or property. <br />363690.2 <br />2077894.1 <br />
