Page 3 of 4 <br />DISCUSSION <br />The City Council, as a legislative body, has been granted the authority to summarily vacate <br />public easements that are no longer needed or relevant, provided the regulatory procedure <br />prescribed by the California Streets and Highways Code is followed. The public easements <br />dedicated by Tract 5189 across the property at 29 Grey Eagle Court require adjustment to <br />address changes in development rights as well as the owner’s proposed use of the property. <br /> <br />Adjustments to the easements were anticipated in 2005 according to the City’s agreement with <br />the owners when the land was purchased for the Bonde II water reservoir. Now that the <br />owners have obtained approval for a custom home on the property, the adjustments are <br />warranted. <br /> <br />Adoption of a Resolution of Summary Vacation for Public Service and Access Easements and <br />Acceptance of Replacement Public Service and Emergency Vehicle Access Easements <br />(Attachment 1) and approval of the Quitclaim of Easement and Grant of Public Service and <br />Emergency Vehicle Access Easements (Attachment 2) would effectuate the easement <br />adjustments without adverse impact to the City’s rights or obligations. <br /> <br />EQUITY AND SUSTAINABILITY <br />Not applicable, as this item is an administrative matter of City business. <br /> <br />OUTREACH <br />Notification letters were sent to utility purveyors who operate in Pleasanton as required by <br />California Streets and Highways Code §8335(b)(5). Although Pacific Gas & Electric Company <br />operates equipment within the public service easement, its rights are protected by an <br />easement granted specifically to them by Robert and Pamela Grove (predecessors to <br />Roberts/Brady) on February 17, 1988 (Document No. 88-041251).
