19.16.080 <br /> 733 (Pleasanton Supp. No. 27, 1-22) <br />or such longer time as mandated by the Subdivision <br />Map Act (see Government Code Section 66463.5). <br /> B. Prior to the expiration of the tentative parcel <br />map, the subdivider may apply for an extension. <br /> 1. The first application may be for an extension <br />of up to 24 months. <br /> 2. Up to four subsequent applications may be <br />made for extensions of 12 months each. <br /> 3. A cumulative total of six years of extensions <br />may be granted as provided in subsections 1 and 2, <br />above. <br /> 4. Extensions granted pursuant to this section <br />similarly extend any city legislative, administrative or <br />other approval that pertains to a development project <br />included in the parcel map if such approval has not ex- <br />pired when a complete application for extension was <br />submitted. <br /> 5. Upon receipt of a written application for an <br />extension which must include the reasons or bases for <br />the requested extension, plus payment of fee, the parcel <br />map shall be automatically extended for 60 days, or until <br />the application is approved, conditionally approved, or <br />denied, whichever occurs first. <br /> 6. The extensions may be approved administra- <br />tively by the director of community development. The <br />director may refer any application for an extension to the <br />review board or to the planning commission for deci- <br />sion. (Ord. 2179 § 2, 2018) <br /> <br />19.16.080 Exemption from final map filing <br />requirement. <br /> Minor subdivisions, as defined in this chapter are <br />exempt from the provisions of Chapter 19.24 of this title <br />requiring the preparation and filing of a final map. (Prior <br />code § 2-3.06) <br /> <br />19.16.090 Appeal. <br /> In the event the subdivider, or a tenant in the case <br />of a proposed conversion to condominiums of the sub- <br />ject property, is dissatisfied with any determination of <br />the director, the review board or its designee, as to the <br />determination to approve or deny an application, modi- <br />fication, or extension, such decision may be appealed to <br />the planning commission in accordance with the proce- <br />dures set forth in Chapter 18.144 (Appeals), and subject <br />to payment of fee. (Ord. 2179 § 2, 2018; Ord. 2000 § 1, <br />2009; prior code § 2-3.07) <br /> <br />19.16.100 Determination by commission. <br /> In the event of appeal, the commission must ap- <br />prove, affirm, reverse or modify any determination of <br />the review board or its designee with respect to the pro- <br />posed minor subdivision, within 30 days after review <br />board action under Section 19.16.040, stating his or her <br />reasons for appeal. (Prior code § 2-3.08) <br /> <br />19.16.110 Waiver of parcel map. <br /> The city planning commission may waive the re- <br />quirements of the state Subdivision Map Act pertaining <br />to the preparation and filing of a parcel map for any di- <br />vision of a parcel or parcels of land into four or less par- <br />cels for purposes of sale, lease or financing, whether <br />immediate or future or to any parcel or parcels of land <br />divided into lots or parcels each a gross area of 40 acres <br />or more or each of which is a quarter-quarter section or <br />larger, provided the planning commission finds that: <br /> <br /> The proposed land division complies with <br />the requirements of this code, including, but not <br />limited to, those provisions relating to area, im- <br />provement and design, flood and drainage control, <br />appropriate improved public roads, sanitary dis- <br />posal facilities, water supply availability, envi- <br />ronmental protection and other applicable provi- <br />sions of the state Subdivisions Map Act. <br /> <br />(Prior code § 2-3.09) <br /> <br />19.16.120 Urban Lot Split. <br /> Notwithstanding the requirements of this chapter, <br />a minor subdivision consisting of an urban lot split as <br />referenced in Chapter 18.101 of this code shall be sub- <br />mitted and approved in accordance with the provisions <br />of Chapter 18.101 of this code.
