HACIENDA BUSINESS PARK MAINTENANCE AGREEMENT NOVEMBER 1983

2.1 2.2 2.3 ARTICLE 2 MAINTENANCE OF STREET LIGHTING Areas for Street Liqhtinq Maintenance. The Association shall maintain all street lighting within the following areas: 2.1.1 HoDyard Road. Hopyard Road from the Arroyo Mocho Canal to Owens Drive, inclusive of said intersections; 2.1.2 Hacienda Business Park. Hacienda Business Park as described in the Declaration; 2.1.3 West Las Positas Boulevard. The described in Section 1.1.3 (including lighting); and area area 2.1.4 Santa Rita Road. Central medians for Santa Rita Road between Pimlico Drive and Sutter Gate Avenue, inclusive of said intersections. Maintenance Requirements. The Association shall at its sole expense maintain all street lighting within the areas described in Section 2.1. Maintenance shall include the payment of all charges for electrical usage, all cost of ownership charges, if any, and the care of all street lighting electroliers and bulbs, including repair and replacement where necessary; provided that the Association's obligations under this section with respect to the area described in Section 2.1.1 shall not include the replacement or repair of street lighting electroliers unless ownership of said electroliers is conveyed to the Association or the City. Terms of Maintenance Obliqations. The Association's obligations under Section 2.2 shall commence upon the later of (i) the date of this agreement, or (ii) the date upon which the City Council of the City accepts ownership of the street improvements and other public improvements under construction and shall continue throughout the term of this agreement, unless terminated as provided in Section 6.3.
