1.3 <br /> <br />1.4 <br /> <br />S~ecial Maintenance Requirements. The Association <br />acknowledges that the City has permitted the <br />installation of Poplar trees within the Common ARea <br />Easements (see Section 1.1.2) located at the <br />intersection of Hopyard Drive and Stoneridge Drive. In <br />the event that the root systems of said Poplar trees <br />cause any damage to, or create any unreasonable <br />maintenance problems for, any sidewalks, water lines, <br />sewer lines, or other underground utilities the <br />Association shall within ten (10) days after written <br />notice from the City, at the Association's sole <br />expense, remove any and all of said Poplar trees which <br />have caused such damage or created such maintenance <br />problem, repair or replace as necessary any damaged <br />sidewalks, water lines, sewer lines or other <br />underground utilities, and replace the Poplar trees <br />removed with street trees approved by the City. <br /> <br />Term of Maintenance Obliqation~. Except as provided <br />below, the Association's obligations under Section 1.2 <br />with respect to the areas described in Sections 1.1.1 <br />through 1.1.6, inclusive, shall commence upon the later <br />of (i) the date of this agreement, or (ii) the date <br />upon which the City Council of the City accepts <br />ownership of the street improvements and/or other <br />public improvements under construction in those areas <br />and shall continue throughout the term of this <br />agreement, unless terminated as provided in Section <br />6.3. The Association's obligations, or those of any <br />Distr~ct established pursuant to Section 6.2, under <br />Section 1.2 with respect to the portions of the areas <br />described in Sections 1.1.1, 1.1.2, 1.1.3, 1.1.4, 1.1.5 <br />and 1.1.6 which are shown on Exhibits, A, B, C, D, E, <br />and F as "Conditional Landscape Zone" and are listed in <br />Exhibit G attached hereto and made a part hereof shall <br />terminate upon the completion of improvements for the <br />development or redevelopment of all or any part of any <br />parcel of real property containing such portion, or, in <br />the Stoneridge Drive median, upon provision for its <br />maintenance by Meyers Properties by agreement with the <br />City or inclusion of this area in a landscape and <br />lighting maintenance district comprised of properties <br />within the Meyers business Park. <br /> <br /> <br />
