or non-compliant conditions in connection with the Equipment, Licensee shall, at <br /> Licensee's sole cost and expense, correct any such defects and conditions within 15 days <br /> after written notice from the City. Licensee shall promptly reimburse the City for all costs <br /> incurred in connection with any inspections or re-inspections by the City. <br /> 6.12. As-Built Plans and Maps <br /> Within 30 days after the City issues a certificate of completion, Licensee shall file as-built <br /> plans and maps in a format specified by the Community Development Director or his/her <br /> designee. Further, all as-built plans and maps shall include digital copies in a native <br /> format compatible with the City's document management, GIS and/or other digital <br /> information management systems. Licensee's as-built plans and maps must show the <br /> accurate location and dimensions for all Equipment. The City shall have the right to reject <br /> any as-built plans or maps for cause, in which case Licensee shall file revised as-built <br /> plans and/or maps within 30 days after notice from the City. <br /> 6.13. Title to Licensee's Equipment and Other Improvements <br /> Except as specifically provided otherwise in this License, all Equipment and other <br /> improvements installed, constructed or placed on or about the License Area by Licensee <br /> or its Agents or Invitees will be and remain at all times Licensee's personal property. All <br /> structural improvements to any Vertical Infrastructure and any replacement Vertical <br /> Infrastructure, as approved by the City and shown in the Approved Plans, will become <br /> City Property and remain City Property should Licensee vacate or abandon such License <br /> Area, unless the City elects in a written notice to Licensee that it does not wish to take <br /> title to such structural improvements. Subject to Section 26 (Surrender of License Area), <br /> Licensee may remove its Equipment from the License Area at any time after 30 days' <br /> written notice to the City. <br /> 7. LICENSEE'S MAINTENANCE OBLIGATIONS <br /> 7.1. General Maintenance and Repair Requirements <br /> Licensee shall maintain all Equipment installed on, under, over, in or about the License <br /> Area in good, safe and orderly condition at all times, and shall promptly repair any damage <br /> to any Equipment whenever repair or maintenance may be required, subject to any <br /> Regulatory Approvals if required for such maintenance work. All work performed by or for <br /> Licensee under this Section 7 shall be performed: (a) in accordance with the terms and <br /> conditions in this License; (b) at Licensee's sole cost and expense, and at no cost to the <br /> City; (c) by only qualified, trained, experienced and appropriately licensed contractors or <br /> Licensee's Agents or other personnel; (d) in a manner and with equipment and materials <br /> that will not interfere with or impair the City's municipal operations on or about the License <br /> Area; (e) in a safe, diligent, skillful and workmanlike manner; and (f) in compliance with <br /> all applicable Laws, which includes without limitation all applicable provisions in the <br /> Pleasanton Municipal Code and any conditions in any applicable Regulatory Approval(s). <br /> {00033905;°/011 <br /> City of Pleasanton, CA 13 <br /> DRAFT Pole License Agreement <br />
