6.8. Underground Service Alert <br /> Licensee warrants and represents to City that Licensee is presently a member in good <br /> standing with the Underground Service Alert of Northern California and Nevada ("USA <br /> North 811"). Licensee shall maintain and keep current its membership in USA North 811 <br /> throughout the Term. Prior to any excavation performed in the Streets, Licensee shall <br /> observe and perform all notice and other obligations required under applicable Laws, <br /> which includes, without limitation, California Government Code §§ 4216 et seq., as may <br /> be amended or superseded. <br /> 6.9. Damage and Repair to Subsurface Structures <br /> Any excavation performed in the Streets must be monitored by Licensee for any lateral <br /> movement, trench failures and other similar hazards. Licensee shall, at Licensee's sole <br /> cost and expense, repair any damage (which includes without limitation any subsidence, <br /> cracking, erosion, collapse, weakening and/or any loss or reduction in lateral or subjacent <br /> support) to the Streets, any adjacent private property, any utility lines or systems (whether <br /> overhead or underground) and any sewer and/or water lines or systems resulting from or <br /> in connection with any excavation by Licensee or its Agents. All repair or restoration work <br /> performed pursuant to this Section 6.8 shall be performed under the supervision and to <br /> the satisfaction of the Community Development Director or his/her designee. <br /> 6.10. Equipment Modifications <br /> If, after the initial construction, installation or other work is completed, Licensee proposes <br /> to modify existing Equipment or install new equipment on the existing License Area, and <br /> such proposal is different in any material way from the specifications or design <br /> configurations shown in the Approved Plans, then Licensee shall first obtain the City's <br /> consent to modify this License to reflect the material difference. No modification to this <br /> License shall be required for any modification to an existing Equipment that (a) involves <br /> only substituted internal components; (b) will be in compliance with applicable Laws (such <br /> as radio-frequency emission standards); (c) does not result in any change to the <br /> Equipment's external appearance, dimensions or weight; (d) and does not cause any <br /> interference with any municipal functions or equipment. In any case, Licensee's <br /> modification shall be performed in compliance with all applicable provisions in this <br /> License, which includes, without limitation Licensee's obligation to obtain and pay for all <br /> Regulatory Approvals required for the proposed modification. <br /> 6.11. Post-Completion Inspections <br /> Within five days after Licensee completes any Equipment construction, installation or <br /> other work, Licensee shall provide the City with a written notice that confirms the precise <br /> locations and dates on which Licensee completed the work. The City shall have the right <br /> to inspect Licensee's Equipment at any time after Licensee completes any construction, <br /> installation or other work in connection with this License.
