Such a voter approved exemption would avoid expensive and time consuming litigation and still provide for the <br />full number of units the developer is requesting. <br />Option D: PP compliant connection to Sunset <br />It looks to possible to build a road that doesn't cross 25% slopes and not have structures within 100' of a ridge <br />by crossing the Sunset Creek HOA land and connecting to Lund Ranch II at a point lower than 415'. This option <br />was brought up by the Planning Commission but was dismissed by Staff because they felt it was unlikely the <br />HOA would consent to such a use of their property. I believe that such a connection should be explored with the <br />HOA, who might consider it if the connection was limited to small number of homes and did not connect to <br />Independence or Lund Ranch roads. In such a configuration, the Council could craft a compromise between the <br />two neighborhoods with each taking some of the traffic of the project.
