Determination that the sale of a portion of the City's water tank site (Bonde II) is in
conformance with the General Plan.

Planning Director Brian Swift presented the staff report, and detailed the history of the
application by Mr. Grove and Mr. Roberts. He noted that the Planning Commission's denial of
the application was appealed to City Council. The Council voted to approve the plan as
previously shown, and the Specific Plan was modified to carve out the corner of land to add the
property to the PUD for the Grey Eagle neighborhood.

/"

Mr. Swift advised that the City Council entered into an agreement with Mr. Roberts for the sale
of the properties in conjunction with its review of the overall PUD. The City Council also
determined that the two slivers of land were surplus, but before the City could sell that land, the
Planning Commission is required to determine that such a sale is consistent with the General
Plan. The lots created through the PUD modification would be Rural Density residential lots,
which staff believed was consistent with the General Plan. The staff report analyzed whether the
land could be used for any other public purpose on the site, and determined that there was no
current necessity for the two slivers of land. Staff finds the sale of a portion of the City's water
tank site was in conformance with the General Plan.

In response to an inquiry by Commissioner Sullivan, Mr. Swift confirmed that the sale would not
be final until the new water tank site has been acquired. He noted that the City identified several
potential sites during the development of the Vineyard Corridor Specific Plan, including the
Resnick, Brozosky, and Berlager properties. He noted that there was no shortages of sites, and
added that the proper location be determined by the construction of access roads, geologic
stability, and cost-effectiveness.

A discussion of the characteristics of the water tank ensued.

THE PUBLIC HEARING WAS OPENED.

There were no speakers.

THE PUBLIC HEARING WAS CLOSED.

,-..

PLANNING COMMISSION MINUTES

October 23, 2002

Page 29
