1 0 <br />City Judge:- -The report showed that $25.00 had been collected during the month of <br />November, 10,3 7. <br />Fire Chief: -- Showing report of activities during the month. Also an invitation to the <br />City Officials to join the Fire Department at a 'Turkey dinner on Tuesday evening, December <br />7th at 60#30 o'clock. <br />He <h Officer: -- Showing report of activities during the month. ; <br />MilksInspector: -- Showing laboratory report on milk samples for November. <br />Ashton 'Britten: -- Showing laboratory report of work done at sewer farm during the month <br />of November: T <br />Building Inspector:- -The Report showed that 2 building permits and 2 electrical permits <br />had been issued during the month. <br />The reports were referred to the finance committee for audit and report. <br />The following communications were then read: <br />November 1st: -- Metropolitan Oakland Committee advising the Council that it was preparing <br />to launch its second year of the "campaign to bring into this area new <br />industries and residents." Also to the affect that the "Board of-Super- <br />visors of Alameda County had made available for the 1937 -38 campaign <br />the sum of $40,000, the City of Oakland set aside $15,000 and that <br />other cities in the county were being asked to invest various sums in <br />this important development project and that the committee felt that <br />Pleasanton's fair -share was $150.00. <br />November 10th - -Mrs. Christine Olesen, expressing appreciation to the Council for its <br />kindness during the death of her husband, Ole Olesen. <br />November 12th -- Pacific Gas & Electric Co. In Re: Electric Franchise from the City of <br />Pleasanton under Franchise Act of 1937 and advising that 14"under this <br />Act the City of Pleasanton would receive approximately $105.00 annually <br />in franchise taxes." "Please understand that an exclusive Franchise is <br />not being applied for and when granted will be subject to approval by <br />the California Railroad Commission. <br />November 22nd-- FacificiTelephone & Telegraph Company, advising the Tax Collector that <br />they were paying under protest the sum $80.08 as and for the first <br />installment of taxes. <br />December 6th -- -John J. Oneil asking permission to remove the remaining trees in the <br />400 Block of First Street as he wishes to put in sidewalks in the <br />spring. Also that he be permitted to plant walnut trees on the other <br />side'of the street which he will be willing to water and take care of. <br />Before calling for a recess, Mayor Orloff introduced jar. Lee Newbert, Division Manager <br />of the.Pacific'Gas & Electric Company who was present at the meeting. 11r.,Newbert stated <br />to-t the Council that he had come to discuss the matter of the electric franchise as <br />outlined in a communication to the Council as of November 12th. He stated. that he would <br />be willing to answer any' questions that the members of the Council might wish to ask him. <br />Councilman Madsen asked Mr. Newbert with regards to distributing electric energy in the <br />future should the town wish to do:,so. Mr. Newbert stated that under the franchise the <br />Council had that privilege.::There being no further questions the Mayor advised Mr. Newbert <br />that the matter would be taken under-advisement and that his company would be notified <br />with regards the action of the Council sometime in the future. Mr. Newbert then retired <br />from the meeting. Later in the meeting, Attorney Nilson was called upon with regards <br />this Franchise. Mr. Nilson.explained that the franchise was similar to the one previous- <br />ly introduced before the Council in 1555,exeeR.0 that the new statute provided more <br />definite the amount that the Town would receive, namely one per cent of,the total <br />gross income. Mr. Nilson again explained that the electric company already has a <br />constitutional franchise and that.at the present time considerable electricaen _ergy is <br />being distributed in the community without granting them a franchise. He pointed out <br />that if the town did-grant the franchise that it was not exclusive and that the 'town <br />could go into the power business at any time and that if-the town did that it was not <br />subject to the Railroad commission as far as the.fixing of rates etc. was concerned. He <br />stated that if the town did grant the franchise it would not handicap matters that there <br />were no objections and that the town should see that the franchise was granted. Council- <br />man Rivolta question Mr. Nilson with regards.distributing electric energy in the <br />future and suggested granting the franchise with the understanding that the town might <br />exercise•its privilege.in the future. Mr. Nilson felt that the town could go ahead <br />with any plan of distributing power on its account without having any understanding <br />in the franchise. Following a short discussion, the matter was laid over until the <br />January meeting -to be heard further. <br />A recess followed during which the finance committee exmained Claims No. 183 to <br />218 inclusive and amounting to $1053.43. After the meeting had.been called to order <br />again, Councilman Rivolta of the finance committee reported that the committee had <br />examined and approved the claims 'and made a motion to the affect that they be paid. <br />His motion was seconded by Councilman Amaral. Councilman Rivolta reported that the <br />officers monthly reports were accepted and he moved that they be placed on file. There <br />were no objections to same. <br />Action on the communications taken as follows: <br />November 1st: -= Metropolitan Oakland. Councilman Amaral a member of the general committee <br />of the Metropolitan Oakland Committee reported what other cities were <br />planning-to do toward the campaign.
