IIG9 <br />Nilson advised that he had received a letter from an attorney for Tars. Lucas which <br />he had replied to advising what IbTr. Richards was willing to do at the time the slope <br />wall matter was under discussion. When Mr. Nilson was queried with regards to what <br />action he would recommend he' advised that members of the Council meet with him at <br />his office and that Mr. Richards 'be also present. Re-advised that while a-Deed. of <br />Trust existed against the property of Mr. Richards that any deed which Mr. Richards <br />might sign -in favor of the town would be subject to that Deed of Trust. He also-advised <br />that he had talked over the property matter with Mr. Richards and that Mr. Richards did not <br />expect.-so much property would be required for the slopewall as the municipality had taken. <br />Mr. Nilson also advised the Town 'to go' ahead and complete the slopewall• project. The <br />discussion concluded with Councilman Olesen being willing to talk further with'Mr.. Harding <br />on the matter and also for the Council.to meet next Monday night in adjourned session <br />and at that time if possible to conclude the matter. At Councilman Olesen's suggestion, <br />Clerk Schween advised with regards to the fill along the slopewall -and to the <br />effect that, he was to visit the VCP.A office on Tuesday afternoon, March 3d for a <br />discussion of same with Mr. Le`e B. Chase, Superintendent of Projects and Planning <br />and Engineers Geo. Ai- Miller and Dick Hartley. , Mr. Schween advised that his under- <br />, standing of the matter was that a certain fund of $1000.00 had been set up for the <br />securing of 1000 cubic yards of backfill for the job, but that Mr. Miller .promised � <br />to have further advice for him when he called at -the office. <br />Councilman Amaral of the Laws and Judiciary committee advised of a,recent meeting <br />that he and Chief of Police Delucchi had attended at the District Attorney's office <br />in Oakland at which discussions were held with, regards to communistic outbreak:.riots <br />etc. which the District Attorney felt that probably might cause a disturbance later <br />in the season. <br />An ordinance fixing the periods for the fiscal years for the Town of Pleasanton <br />was then introduced by Councilman Amaral,. According to this ordinance, the fiscal <br />years of the Town of Pleasanton for all purposes' including the making- of reports <br />and accountings and the fixing of budgets, shall, from and after the passage of <br />this ordinance, begin on the 1st day of July of each calendar year and terminate.:.gn <br />the 30th day of June of the following calendar year. "' Same was ordered laid on <br />the table until the adjourned meeting on March 9th. <br />The Clerk then brought up Resolution 1579, a resolution "Authorizing the Creation <br />of a Special Fund to-be known, as "Mater Surplus Fund" of .the Town of Pleasanton, and <br />directing certain expenditures to' be charged to and made therefrom." After reading <br />this resolution he explained that he had had advice to the effect that it would be <br />best for the Town to' set up a special fund from the surplus of the water department <br />to be used in connection,with the Curb and Gutter work and the special street work, <br />to tak6 this surplus from the general fund and then later when the work had been <br />completed to return it to your general fund. After some discussion of. the matter it <br />was decided to- estabiish the fund for the period beginning July 1, 1935 and ending <br />March 31, 1936. The resolution was adopted on motion of Councilman Amaral, seconded <br />by Councilman 'Olesen and with all the councilmen present in favor of saem. <br />The Clerk then advised the Council with reference to the municipal election on <br />Tuesday, April 14th and to the effect that it would be necessary for the Council <br />to meet on or before March 14th,�',name: the election officers, and set the place <br />for the holding of the election. He presented applications to serve as election <br />officers from Mrs. Edith Ziegenfus$, Ifiss Mary Ellen Steane and Miss Carolyn N. Ward. <br />Following a• discussion between the Council members and the Clerk it was decided that <br />these three applications would be accepted and 'that the selection of a fourth officer <br />would be deferred until the-next meeting at which, time 1"Ar. Madsen might name an officer. <br />The following resolutions were then presented: <br />Resolution No. 1576 -- Authorizing the payment of the <br />and amounting to $745.00. <br />No- 1577 -- Authorizing and instructing th <br />Town Treasurer in favor of the <br />Fund for the sum' of x$3.45. <br />salaries of the municipal officers <br />e Clerk to draw a warrant on the <br />Curb and Gutter project revolving <br />It If u N o.1578 -- Authorizing the Clerk to Cancel License No. '135 - M'rs.
