PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-87-O1 <br />RESOLUTION APPROVING CASE UP-86-56, FOSTER EXCAVATING, <br />INC. <br />WHEREAS, Foster Excavating, Inc. has applied for an extension of <br />a conditional use permit to operate a contractor's <br />office and equipment storage yard located on an <br />approximately one acre site at 3932 Old Santa Rita Road; <br />and <br />WHEREAS, zoning for the property is CS (Commercial Service) <br />District; and <br />WHEREAS, this project is categorically exempt from the <br />requirements of CEQA; and <br />WHEREAS, at their duly noticed public hearing of January 14, 1987 <br />the Planning Commission made the following findings <br />after taking all public testimony, reviewing all <br />pertinent exhibits and recommendations of the City staff <br />concerning this application: <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purposes of the district in which <br />the site is located. <br />The purpose of the CS zoning district is to <br />accommodate uses that are not otherwise compatible <br />with residential, neighborhood and business park <br />uses. Because of the number of similar open <br />interim uses along Old Santa Rita Road and due to <br />the location of the site away from any conflicting <br />uses, the use would be appropriate. <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />The subject site is located directly adjacent to a <br />similar vehicle storage yard to the south. In <br />addition, similar type uses exist at other <br />locations on Old Santa Rita Road. The use would <br />continue to adhere to the requirements of the City <br />Building, Engineering and Fire Department. <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of this chapter. <br />- 1 - <br />
